8. Several provisions of the draft Decree concern technical regulations within the meaning of this Directive, such as the provisions relating to:

- car park lighting (Article 31)
- requirements in terms of accessories and equipment for gas pipes (Article 34)
- fixed CO and NO2 monitoring equipment (Article 43)
- the apparatus used to measure carbon monoxide and nitrogen oxide (Article 58)

9. Air quality is a recurring problem in the BCR, as evidenced by several ‘calls to order’ at European level. In 2009, the BCR was the recipient of a formal notice (No 2008/2184) for non-compliance with the daily limit values for fine particulate matter (Directive 2008/50/EC of the European Parliament and of the Council of 21 May 2008 on ambient air quality and cleaner air for Europe). In 2016 and 2018, the BCR and all of the Regions were the recipients of a formal notice (No 2016/2005) for non-compliance with the annual limit values for nitrogen dioxide (Directive 2008/50/EC).

Following these observations, it is therefore necessary to apply strict emissions limits for parking facilities. Fine particulate matter and nitrogen oxide have a significant impact on health. It is therefore particularly important that parking facilities do not reduce air quality as a result of their emissions, and do not therefore contribute to European standards being exceeded and life expectancy being decreased.

The Decree also covers the protection and safety of users in and around parking facilities (e.g. lighting, fire prevention, etc.)
