8. The draft Act aligns the national legal situation with Regulation (EU) 2023/1542 and lays down the necessary procedures and competent authorities for this purpose. Use is also being made of flexibilities that are open to the Member States under the Regulation. In this context, Article 1, Section 4(3) of the draft provides for an obligation on providers of online platforms to allow producers to offer batteries only if they are duly registered in accordance with Article 55(2) of Regulation (EU) 2023/1542.
