5. Government proposal to Parliament for an Act amending the Waste Act

6. Single-use plastic products and nicotine pouches listed in Part E of the Annex to Directive (EU) 2019/904 on the reduction of the impact of certain plastic products on the environment.

The proposal proposes amendments to the extended producer responsibility under Article 8(2) and (3) of Directive (EU) 2019/904 on the reduction of the impact of certain plastic products on the environment. The proposal proposes that the compensation paid by producers to municipalities for the costs referred to in the aforementioned paragraphs would be based on a fixed annual cost per capita, with the exception of collection containers for tobacco waste, the costs of which should be reimbursed in accordance with the actual costs incurred. A Government decree would lay down more detailed provisions on the aforementioned fixed annual cost per inhabitant and its allocation by litter prevention and cleaning measures and by product group.

It is also proposed that the prevention and cleaning of nicotine pouch litter should be included in the scope of the producer’s liability for costs. Producers of nicotine pouches would be obliged to reimburse municipalities for the costs incurred in collecting nicotine pouch litter and cleaning up litter in certain public areas, as well as for information and advice on the prevention of nicotine pouch litter.

9. The purpose of switching to a fixed annual cost per resident is to reduce the regulatory burden on authorities and municipalities, which arises from implementing producers’ liability for costs, and to improve the predictability of producers’ liability for costs.

The proposal also aims to promote equal treatment of producers of products that cause littering and to transfer the costs of collecting and cleaning up nicotine pouch waste from municipalities to producers. Another goal is to reduce nicotine pouch litter.
