5. Royal Decree establishing various provisions relating to narcotic drugs and psychotropic substances

6. Narcotic drugs and psychotropic substances (specifically those listed in Annex 4 - these are the purely national additions)

8. A number of narcotic drugs and psychotropic substances will be added to the substances that fall under the drug surveillance and control mechanisms. Some of these substances will be added pursuant to international obligations and, as such, form an exception to the Regulation.

9. The control measures in question will target new psychoactive substances that pose a risk to public health. We are of the opinion that it is possible to invoke Article 1a of Council Framework Decision 2004/757/JHA of 25 October 2004 laying down minimum provisions on the constituent elements of criminal acts and penalties in the field of illicit drug trafficking, as it states that Member States may take action to impose control measures on substances that do not fall under UN conventions on narcotic drugs and psychoactive substances.

However, since the Council of State has ruled that a notification is still necessary (see the advice in annex à), it is submitted herewith.
