8. The draft Regulation on the method of determining the number of end-of-series vehicles and model documents related thereto specifies how the number of vehicles to be included in the end-of-series is to be determined and provides the model documents related to the end-of-series procedure, taking into account the need to ensure an appropriate level of safety, protection of health and the environment, and the functionality and integrity of the documents, and thus:
1. The maximum number of complete and completed vehicles of one or more end-of-series vehicle types shall not exceed 10 % for vehicles of category M1 or 30 % for vehicles of categories M2, M3, N or O — applicable to vehicles of all these types placed on the market in the territory of the Republic of Poland in the previous year. If the figure corresponding to 10 % or 30 % respectively referred to in paragraph 1 is less than 100, the maximum number of complete and completed vehicles of one or more end-of-series vehicle types shall not exceed 100 vehicles.
2. For vehicles of categories T, C, R and S, it is planned that the maximum number of vehicles of one or more end-of-series vehicle types shall not exceed:
1) 10 % of the number of vehicles of all these types placed on the market in the territory of the Republic of Poland in the two previous years, or
2) 20 vehicles placed on the market in the Republic of Poland
— depending on which value is greater.
3. However, in the case of L-category vehicles, it is planned that the maximum number of vehicles of one or more end-of-series vehicle types shall not exceed:
1) 10 % of the number of vehicles of all these types placed on the market in the territory of the Republic of Poland in the two previous years, or
2) 100 vehicles placed on the market in the Republic of Poland
— depending on which value is greater.
In addition, the draft regulation sets out the following models:
1. an application for an end-of-series vehicle authorisation for road traffic;
2. a list of VIN numbers of the vehicles covered by the application for an end-of-series vehicle authorisation for road traffic;
3. the manufacturer’s declaration that the vehicle is subject to an end-of-series vehicle authorisation for road traffic;
4. a list of persons authorised to sign the manufacturer’s declaration that the vehicle is subject to an end-of-series vehicle authorisation for road traffic;
5. the manufacturer’s declaration that the vehicle indicated in the list of VIN numbers holds a certificate of conformity issued during the period of validity of the EC vehicle type-approval certificate, EU vehicle type-approval certificate or national type-approval certificate for vehicles produced in small series respectively.
9. The draft Regulation on the method of determining the number of end-of-series vehicles and model documents related thereto constitutes the implementation of the delegation contained in Article 56 of the Act of 14 April 2023 on the approval systems of vehicles and their equipment (Journal of Laws item 919), i.e. the law newly adopted in Polish legislation.
In view of the adoption of the above-mentioned Act and the delegation concluded therein, it was necessary to regulate the relevant provisions by means of a national regulation.
