5. Draft Law amending Articles 2, 3, 4, 12, 13, 14, 15, 16, 17, 18 and 19 of Law No. XII-336 of the Republic of Lithuania on hemp grown for fibre

8. The draft act:
1. Amends the definitions of fibre hemp derived products and fibre hemp products;
2. Lays down that hemp grown for fibre may be cultivated in covered areas by producers of hemp grown for fibre who conduct scientific research, subject to appropriate authorisation;
3. Establishes that the THC content in hemp grown for fibre, derived products and products can be tested by all accredited laboratories;
4. Only applies the 0.2 THC restriction to fibre hemp derived products placed on the Lithuanian market;
5. Establishes that if, during the production process of fibre hemp products and/or derived products, intermediate products of hemp grown for fibre are formed and/or materials are formed during the processing of raw parts of hemp grown for fibre and seeds of hemp grown for fibre, whose THC content exceeds the permitted limit of 0.2 percent, only legal persons established in the Republic of Lithuania and branches of foreign legal persons and other organisations established in Lithuania shall have the right to carry out such production upon obtaining an authorisation to carry out the activity of the production of fibre hemp products and/or derived products, during which intermediate products of hemp grown for fibre are formed, and/or materials are formed during the processing of raw parts of hemp grown for fibre and seeds of hemp grown for fibre where the THC content exceeds the permitted limit of 0.2 percent, are used.
6. Establishes an obligation for producers, importers and exporters to submit information on the turnover of fibre hemp products and derived products to an institution authorised by the Government.

The aim of the draft is to enable producers of fibre hemp derived products to not only place the product intended for final consumption on the market but also the raw material for the production of other derived products (B2B), to enable laboratory tests to be carried out not only in a single state-run laboratory but also in other accredited laboratories, to enable research to be carried out in covered areas for producers of hemp grown for fibre, as well as to determine the maximum permitted tetrahydrocannabinol content of fibre hemp products, intermediate products and derived products produced for export, not in accordance with the legal requirements of the Republic of Lithuania but in accordance with the legal requirements of the country to which the products and derived products are exported. These changes will promote the development of biotechnology in Lithuania, create favourable competitive conditions for Lithuanian producers, and encourage the development of the sector.
