5. Decree of [...] amending the Environmental Activities Decree, the Environmental Structures Decree, etc. (2025 Consolidated Environmental Decree under the Environment and Planning Act (Infrastructure and Water Management))
6. The Consolidated Decree provides for technical amendments (correction of omissions) and policy-neutral amendments to regulations related to the Environment and Planning Act with regard to environmental aspects such as air, noise and external safety.

The 2025 Consolidated Environmental Decree under the Environment and Planning Act (Infrastructure and Water Management) (Verzamelbesluit Omgevingswet IenW milieu 2025) contains amendments to the Environmental Activities Decree (Besluit activiteiten leefomgeving; hereinafter: Bal), the Environmental Structures Decree (Besluit bouwwerken leefomgeving; hereinafter: Bbl), the Environmental Quality Decree (Besluit kwaliteit leefomgeving; hereinafter: Bkl), the Environmental Decree (Omgevingsbesluit; hereinafter: Ob), the 2005 Asbestos Removal Decree (Asbestverwijderingsbesluit), the Decree on Administrative Provisions on Road Traffic (Besluit administratieve bepalingen inzake het wegverkeer), the Decree on Safety Regions (Besluit veiligheidsregio’s; hereinafter: Bvr) and the Landfills and Waste Dumping Prohibitions Decree (Besluit stortplaatsen en stortverboden afvalstoffen). The Consolidated Decree contains policy changes of minor importance as well as technical changes. These changes all relate to the protection of the environment and the physical living environment.
The following amendments relate to amendments to the Bal and may contain technical regulations that need to be notified:
- Article I(T) and (U) [Article 4.127 of the Bal];
- Article I(V) [Article 4.129 of the Bal];
- Article I(W) [Article 4.130 of the Bal];
- Article I(X) [Article 4.131 of the Bal];
- Article I(Y) [Article 4.132 of the Bal];
- Article I(Z) [Article 4.313 of the Bal];
- Article I(AH) [Article 4.1069 of the Bal].
- The amendment of ‘motor vehicles’ to ‘motorised vehicles’ in the text of the regulation.
This amendment is included in the following articles:
Article I(K) [Article 3.152], (L) [Article 3.185], (M) [Article 3.186], (AD) [Article 4.365], (AE) [Article 4.366], (AF) [Articles 4.518, 4.520, 4.573, 4.576, 4.577, 4.587, 4.588, 4.590, 4.1063 and 4.1064], (AV)(2) and (3), [Annex I(A) to the Bal] and (AX) [Annex IVa(A)(a) to the Bal];
- Article I(AC) [Article 4.320 of the Bal].
The amendments relate to all articles from the Bal. A mutual recognition provision is included in Article 1(3) of the Bal.
9. Articles 4.127, 4.129, 4.130, 4.131. 4.132a may contain technical regulations on measurements of emissions and their frequency and duration. This is mainly a clarification of the measurement and monitoring regime for these substances. These measures contribute to environmental protection and are necessary for proper measurement and monitoring. Article 4.313 may contain technical requirements on the techniques to be used when crushing rubble and requires effective dust control, and Article 4.1069 may contain technical requirements for the loading and unloading of dust-sensitive goods. Both articles are necessary in the interests of the protection of the environment, are suitable for protecting that interest and do not go beyond what is necessary.
With regard to all amendments, it holds that these are amendments with possible technical requirements necessary for the protection of the physical environment, as well as for ensuring safety and health. The provisions apply without distinction to all businesses, and the provisions do not differentiate between national and foreign goods and services. The provisions apply without distinction and are therefore non-discriminatory. The provisions are proportionate.
