5. Draft Regulation of the Finnish Transport and Communications Agency on critical parts of a communication network
(TRAFICOM/36420/03.04.05.00/2025)

6. Technical regulation on network security. This regulation pertains to the components of a communications network or service.

8. The regulation updates the Finnish Transport and Communications Agency’s Regulation on Critical Parts of the Communications Network issued on 19 May 2021 (TRAFICOM/161584/03.04.05.00/2020). The regulation technically defines in more detail the critical parts of the communications network referred to in section 244a of the Act on Electronic Communications Services that are subject to the obligations of the regulation. According to the Act, “the critical parts of a communication network refer to key functions and measures to control or manage access to the network and traffic in the network in an essential manner”

The regulation updates the general technology-neutral definition of critical parts of the communications network set out in the previous regulation, as well as the more specific definitions concerning the latest mobile network technologies, particularly 5G networks. The preparation of the regulation has been based on ETSI standards and 3GPP technical specifications.

The draft law containing the empowering provision (section 244a) was the subject of Notice No 2020/574/FIN and Notice No 2021/0137/FIN on the regulation of 19 May 2021 (TRAFICOM/161584/03.04.05.00/2020).

According to subsection 6 of Section 244a (1207/2020) of the Act on Electronic Communications Services (917/2014), the Finnish Transport and Communications Agency shall issue more detailed regulations on the technical specification of communications networks, particularly their critical parts, taking into account the recommendations of the Network Security Council referred to in Section 244b.

The regulation guides telecommunications companies and separate network operators covered by the regulation in the design of networks, the procurement of network devices and the construction, maintenance and management of networks. This regulation promotes national security and information security in communication networks.

The objective of the regulation on critical parts of communication networks is to ensure the security of communication networks from the point of view of national security. The regulation also seeks to take into account the EU's common approach to security concerns related to 5G networks.
