8. The Regulation replaces the existing Chemicals-Climate Protection Regulation and contains additional requirements to the F-gas Regulation (EU) 2024/573. Essentially, the Regulation recasts the previous national requirements for the certification of personnel and companies and supplements them with provisions on refresher courses and on the conversion from old to new certificates (§§ 6 to 13). It also clarifies the operator obligations (§ 15) and the obligations of the F-gas Regulation (EU) 2024/573 (§ 16) aimed at the sale and purchase of fluorinated greenhouse gases by reference to the national certification scheme. In addition, the Regulation retains the previous national emission limit values for equipment containing fluorinated greenhouse gases (§ 3). It extends the current collection obligation for hydrofluorocarbons to all fluorinated greenhouse gases, whereby the collection of hydrofluorocarbons shall be carried out free of charge after a transitional period (§ 5). The Regulation maintains the obligation to provide certain information in German in user manuals and descriptions used for advertising purposes and supplements an obligation to mark facilities when using the safety exception (§ 14).

9. The Regulation primarily implements the certification requirements of Article 10 of the F-gas Regulation (EU) 2024/573. The emission control and labelling rules already in place to specify the F-gas Regulation (EU) No. 517/2014 will be updated by reference to the new F-gas Regulation (EU) 2024/573. Leakage control rules for mobile equipment now included in Union law are deleted. The F-gas Regulation (EU) 2024/573 provides for bans on the use of new F-gases after transitional periods. Therefore, the reprocessing and recycling of hydrofluorocarbons should be supported by the obligation to take back used substances free of charge.
