5. Regulation of the Minister for Climate and the Environment on specific rates of product fees for individual products
6. Fee rates for specific products (i.e. certain lubricating oils, lubricating preparations and tyres) as well as fishing gear containing plastic, related to the achieving of collection, recovery and recycling targets.

The new Regulation on fee rates implements the statutory authorisation contained in Article 14(4) of the Act of 11 May 2001 on the obligations of entrepreneurs as regards the management of certain types of waste and on product fees (Journal of Laws [Dziennik Ustaw] 2024, item 433) and is a continuation of the Regulation of the Minister for Climate of 19 December 2019 on specific rates of product fees for individual products (Journal of Laws, item 2485), which expired pursuant to Article 18(1) of the Act of 14 April 2023 amending the Act on the obligations of entrepreneurs as regards the management of certain types of waste and on product fees, and certain other acts (Journal of Laws, item 877) on 24 May 2025. Fee rates for fishing gear containing plastic have been added thereto.
9. The obligations regarding the product fee arise from the Act, while the Regulation only determines their rates. Entrepreneurs placing on the market products listed in Annex 4a to the Act, recovery organisations acting on behalf of the above-mentioned entrepreneurs, as well as entrepreneurs placing on the market fishing gear containing plastic are obliged to calculate, using the appropriate rate, and pay the product fee in the event of failure to achieve the required level of recovery, recycling or collection of certain waste.
The draft Regulation will not introduce any new solutions for the products listed in Annex 4a to the Act, being only a continuation of the existing regulation in this respect. Furthermore, the draft Regulation does not introduce new obligations for entrepreneurs, but only determines the amount of the product fee for fishing gear containing plastic.
