5. Draft Royal Decree establishing provisions regarding construction products

6. The draft regulation addresses the implementation in Spain of certain aspects of Regulation (EU) 2024/3110 (harmonised rules for marketing construction products) and establishes requirements for certain products not subject to European regulations.

This draft Royal Decree implements aspects of Regulation (EU) 2024/3110 of the European Parliament and of the Council of 27 November 2024, which lays down harmonised rules for marketing construction products, repealing Regulation (EU) No 305/2011, such as the methods for addressing construction products in building codes or the penalty system.

In addition to the foregoing, this Royal Decree also aims to update national regulations for certain products not addressed by European regulations.

9. There are certain aspects of Regulation (EU) 2024/3110 of the European Parliament and of the Council of 27 November 2024 that should be developed at national level, such as the penalty system.

At the same time, there are some products related to the construction sector that are not subject to this European regulation, and, due to the absence of applicable European regulations, national requirements should be established for these products to ensure safety at construction sites where these products are used.
