The draft decree is adopted pursuant to Article 41 of Law No 2024-449 of 21 May 2024 aimed at securing and regulating the digital space, which has authorised, on an experimental basis and for a period of three years, the operation of online games that enable players of legal age, who have agreed to incur a financial outlay, to obtain monetisable digital items through a mechanism involving chance.
In this context, the draft decree defines the terms and conditions for displaying the warning message about the risks associated with excessive or pathological gambling that operators offering games involving monetisable digital objects must display on their gaming interface.
9. The experimentation with games involving monetisable digital objects is part of the development of so-called “Web 3.0” technologies, including in particular blockchain, which provides powerful opportunities for development and innovation for online gaming operators.
As French legislation on games of chance and gambling is difficult to adapt to this new activity, which borrows from both video games and gambling, the legislator has created a separate experimental regime, lasting three years, with the aim of supervising and regulating online gambling activities, and which allow players to obtain, primarily, monetisable digital objects and, secondarily, other capped rewards, except those in legal tender. Monetisable digital objects are defined by the legislator as game elements that grant players one or more rights associated with the game and that may be transferred, directly or indirectly, against payment to third parties (such as non-fungible tokens or utility tokens).
