5. Draft Decree amending NMHH Decree No 7/2015 of 13 November of the National Media and Infocommunications Authority on national frequency allocation and on the rules of use for frequency bands and NMHH Decree No 5/2024 of 23 April amending that decree

With the amendment of NMHH Decree No 7/2015 of 13 November of the National Media and Infocommunications Authority (NMHH) on national frequency allocation and on the rules of use for frequency bands and NMHH Decree No 5/2024 of 23 April of the National Media and Infocommunications Authority amending that Decree, the aim is to revise the national frequency allocation and the rules of use for frequency bands, pursuant to Section 10(1)(22) and (24) of Act C of 2003 on electronic communications, with particular regard to:
(a) the obligations arising from relevant international agreements, thus
(aa) the fulfilment of obligations related to ITU's (International Telecommunication Union) decisions, and
(ab) and the fulfilment of implementation obligations due to changes in EU rules,
(ac) the administration of the changes made to CEPT/ECC (Electronic Communications Committee of the European Conference of Postal and Telecommunications Administrations) documents,
(ad) the administration of the amendments that were made to the regional arrangement concerning the radiotelephone service on inland waterways,
(ae) the administration of changes to international coordination documents,
(b) the creation and/or clarification of rules related to the introduction of new applications, user needs, and
(c) the incorporation of text clarifications of a technical nature, based on the experience of enforcement authorities.

The ITU International Radio Regulations (the International Radio Regulations (RR – Radio Regulations) are administrative regulations binding on ITU member states) were published in 2024 in accordance with the decisions of the 2023 World Radiocommunication Conference, and the draft also serves the purpose of developing domestic regulations in line with the amendments.
The regulations governing SRDs, i.e. short-range devices, need to be continuously developed, and so the regulations for applications related to special events (i.e. PMSE (Programme Making and Special Events) applications) that fall within the scope of SRDs have also been subject to overall review. The draft contains the provisions necessary to transpose Commission Implementing Decision (EU) 2025/105, Commission Implementing Decision (EU) 2025/650 and Commission Implementing Decision (EU) 2025/913. In relation to the standardisation results for radio communication equipment, the draft also transposes Commission Implementing Decisions (EU) 2025/893 and (EU) 2025/1741. Furthermore, the relevant new CEPT Decision (ECC/DEC/(21)02) and the changes made to the already transposed CEPT Decisions and Recommendations have also been incorporated.
The draft also updates Annex 4 on international coordination documents, taking into account the changes to the coordination rules of the ITU International Radio Regulations and a coordination agreement concluded in 2025.
In the case of amateur and satellite amateur service applications, the detailed specifications of transmission modes that have become restrictive due to the technological advancement will be eliminated, and only their main groups will remain in the draft.
In the 2300 MHz frequency band, the existing frequency band of the planned category will be opened, i.e. it will have a designated status on the basis of the draft. 40 MHz from the lower band edge may be acquired by undertakings designated by the Government, for national use under block management within the framework of civil use. The adjacent 40 MHz band will be available for use for military purposes, also nationwide, in the context of non-civil frequency management. The remaining 20 MHz will remain to be used within the framework of other non-civil management. The technical rules are the same for the entire frequency band, regardless of civil or non-civil, national or local use.
In the 3600 MHz frequency band, the draft introduces a new, restrictive rule on the protection of earth stations in the fixed-satellite service against MFCN (Mobile/Fixed Communications Networks. (In connection with the convergence of fixed and mobile wireless radio communications services, CEPT regulations have introduced the collective term MFCN (Mobile/Fixed Communication Networks), which also includes IMT (International Mobile Telecommunications) systems in accordance with the ITU wording). According to the new rule, repeater stations, central stations and fixed stations may only be installed in a defined geographical location within a 15-km radius after prior coordination of civil and non-civil radio spectrum management aspects, so that users with a framework permit may only install transmitter equipment in the given geographical environment after prior coordination.
The draft also includes a review of the deadlines that have expired or will expire in the near future, and in this context allows the extension by one year of the deadline for switching the existing broadband digital cellular network to another channel in the 450 MHz band, and the extension by 2 years of the expiring deadline of the 160 MHz band railway systems which have technical characteristics that deviate from the general rule.
