5. Draft Rules on HR Fertilising Products
6. HR fertilising products — fertilisers, liming materials, soil improvers, growing media, inhibitors, plant biostimulants, fertilising product blends

8. Within the scope of its competences, the Ministry of Agriculture, Forestry and Fisheries has prepared the Draft Rules on HR Fertilising Products, pursuant to Article 17(3) of the Act on Fertilising Products (Official Gazette of the Republic of Croatia, No. 39/23).
These Rules prescribe the classification of HR fertilising products according to functions, quality requirements for HR fertilising products, the method and content of marking the HR fertilising product and deviations from the declared content.
9. The aforementioned Rules shall enable economic operators to place fertilising products on the Croatian market in accordance with the Act on Fertilising Products (OG No. 39/23), in addition to the existing placing on the market within the framework of Regulation (EU) 2019/1009.
Regulation (EU) 2019/1009 is directly applicable in all EU member states; it does not replace national legislation and does not prevent non-harmonized fertilising products from being available on the single market in accordance with national legislation. In this way, economic operators will be provided with an alternative solution for the fertilising products they wish to market at the national level to have a simpler path to registration.
Draft Rules on HR Fertilising Products is completely a non-harmonized national regulation, i.e., it is not regulated by EU regulations. The aforementioned regulation regulates the placing of non-harmonized fertilising products on the market and does not contain provisions that represent additional restrictions on the entry of foreign products into the Croatian market.
As a result of the above, economic operators will have the possibility to choose how to place fertilising products on the market, as EU fertilising products with the CE mark in accordance with Regulation (EU) 2019/1009 or on the basis of national legislation, in accordance with the Act and Rules.
An HR fertilising product means a substance, mixture, micro- organism or any other material, applied or intended to be applied on plants or their rhizosphere or on mushrooms or their mycosphere, or intended to constitute the rhizosphere or mycosphere, either on its own or mixed with another material, for the purpose of providing the plants or mushrooms with nutrient or improving their nutrition efficiency, when it is first placed on the EU market in the Republic of Croatia.
