5. Government Decree amending the Annex to the Government Decree on psychoactive substances prohibited on the consumer market.

A total of 27 new substances will be classified as psychoactive substances prohibited from the consumer market.

Finland intends to classify the substances in the enclosed annex as psychoactive substances prohibited from the consumer market, as a result of which the manufacture, import, storage, sale and supply of these substances will be prohibited. An exemption is made for their use for scientific research and industrial purposes. Possession and use of these substances is not punishable.

A total of 27 substances that are considered important to place under control as psychoactive substances prohibited from the consumer market will be added to the annex to the Government Decree. All these substances have appeared on European consumer markets, primarily for no other real use but mind-altering purposes, that is, for intoxication. These substances are neither medicinal products nor narcotic drugs and do not have any known industrial applications.

9. It is proposed that 27 new substances that may be harmful or dangerous to health when used for intoxication purposes be classified as psychoactive substances prohibited from the consumer market. These substances have been notified to the European system and they have not previously been subject to control in Finland.

These substances can also be ordered to Finland, for example, through online marketing. The legal status of these substances varies by country, which enables the market to grow. New designer drugs that are not medicinal products, are not, in principle, subject to control in Finland.

Criminal groups are constantly trying to find new substances that are outside the scope of current legislation. Therefore, these identified substances, which are used as designer drugs and have been observed on the European markets and may pose a health hazard, must be swiftly prohibited by a government decree.

Their inclusion in the list of controlled substances depends on whether they have been associated with use for purposes of intoxication in Finland or elsewhere in Europe, and whether the substances have been notified to the European Early Warning System. These substances are neither medicinal products nor narcotic drugs and do not have any known industrial applications.

12. Protection of public health.
Some of the designer drugs arriving in Finland are outside the scope of control. Among them are potentially dangerous substances that, due to a lack of more specific estimate, should be removed immediately from the consumer market. The harm caused by such substances will be more difficult to prevent if their use for intoxication purposes becomes established. Authorities are not aware of any industrial applications for these substances. The amendment to the Decree does not make research or industrial activities subject to authorisation.
