8. Licensees offering games that require registration in accordance with Chapter 12, Section 1 of the Gambling Act (2018:1138) are obliged under the gambling regulation to check whether a person is suspended from gambling in the national
self-exclusion register (Spelpaus.se) when a player registers, logs into the gambling system, and ahead of
direct marketing. In connection with decisions to grant a licence, the licensee is allocated unique
connection details to Spelpaus.se. When the licensee is to make a check in Spelpaus.se, there are three different Application Programming Interfaces (APIs) to choose from. The Draft contains rules stipulating that licensees must use their unique connection details when checking Spelpaus.se, and that they must use the API intended for checking the register.

The purpose of the Draft is to ensure accurate information in the national self-exclusion register Spelpaus.se, which will improve the Swedish Gambling Authority’s ability to check whether licensees have fulfilled their obligations under the gambling regulation and thereby maintain a strong consumer protection on the Swedish gambling market.

In drawing up the regulations, the Swedish Gambling Authority has taken into account the requirements for legality, predictability and proportionality of the Treaty on the Functioning of the European Union (TFEU). The assessment of the Swedish Gambling Authority is that this regulation complies with the obligations arising from Sweden’s accession to the EU.
