8. This proposal for Rules amending the Rules on packaging and packaging waste changes the definition of a ‘beverage’ by including milk and liquid dairy products in the existing definition, thereby adding the packaging of milk and liquid dairy products and packaging of beverages with volume equal to 0.2 l into the existing national ‘deposit-refund system.’ For the purposes of harmonisation with the national Act on Sustainable Waste Management, the definition of a ‘producer’ is changed. It also changes the provisions related to the provider of the public service of collection of mixed and biodegradable municipal waste who participates in the packaging waste collection system, so that the public service provider is entitled to a fee from the Environmental Protection and Energy Efficiency Fund (the Fund) for covering costs of separate collection and classification of packaging waste based on the amount collected and delivered to the processor. Also, a provision is added which lays down that the collector is also entitled to a fee from the Fund for packaging waste it exported for processing outside of the Republic of Croatia with prior approval of the Fund.

9. Development of the proposal for the Rules amending the Rules on packaging and packaging waste commenced because of the obligation to meet defined targets in the management of packaging waste and of other types of waste that the Republic of Croatia as an EU Member State must meet currently, and that it must meet in the forthcoming period, all pursuant to the provisions of EUROPEAN PARLIAMENT AND COUNCIL DIRECTIVE 94/62/EC of 20 December 1994 on packaging and packaging waste, EUROPEAN PARLIAMENT AND COUNCIL DIRECTIVE 2008/98/EC of 19 November 2008 on waste and repealing certain Directives, and the COUNCIL DIRECTIVE 1999/31/EC of 26 April 1999 on the landfill of waste. Considering the importance of these obligations and ambitiousness of future targets, these amendments to the existing Rules on packaging and packaging waste try to improve the existing packaging waste management system in the RC, and to contribute to the achievement of aforementioned targets to an appropriate extent.
