5. Draft Regulation of the Minister of Infrastructure and Construction on the manner of declaring the performance properties of construction products and the manner of marking them with construction marking

8. The draft Regulation of the Minister for Infrastructure and Construction on the method of drawing up a declaration of performance for construction products and applying a construction mark thereon lays down:
- the groups of construction products for which a national declaration of performance should be drawn up;
- national systems of assessment and verification of consistency of performance of construction products appropriate for these groups;
- the method of drawing up a declaration of performance for construction products;
- the template and content of a national declaration of performance;
- the method of providing a national declaration of performance to consumers of construction products;
- the method of applying a construction mark on construction products and the range of information accompanying the mark.
9. The draft Regulation implements the statutory authorisation under Article 8(8), amended in 2015, of the Construction Products Act of 16 April 2004 (Journal of Laws [Dziennik Ustaw] 2014, item 883; 2015, item 1165; and 2016, item 542).
The provisions of the draft Regulation do not apply to products to which harmonised standards apply or to those in conformity with the European Technical Assessment issued for them, which are placed or made available on the market in accordance with Regulation (EU) No 305/2011 of the European Parliament and of the Council of 9 March 2011 laying down harmonised conditions for the marketing of construction products and repealing Council Directive 89/106/EEC (OJ L 88, 4.4.2011, p. 5), nor to construction products placed on the market on the basis of the mutual recognition principle.
