8. The amendment proposes the introduction of a requirement for an interface via which digitally coded content can be received and played back. Given that said requirement only refers to devices that can display the programme name, it is limited to high-end devices. The objective of amending § 48 of the Telecommunications Act is to ensure that high-end radio receivers may only be traded if they are capable of receiving standardised digital signals from any digital distribution channel.

The digitisation of radio gives radio programme providers numerous possibilities to increase the diversity of their content and provide users with a higher-quality product in terms of sound quality. Contrary to developments in other EU Member States, the market penetration of end devices capable of receiving digital channels is sluggish. Furthermore, relevant initiatives undertaken by the Federal Government and the federal states have not led to a noticeable increase in the market penetration of digital devices. The aim of the statutory regulation is to encourage the more widespread use thereof.

15. The legal requirement will entail additional expenditure for device manufacturers due to the addition of a digital receiver. This additional expenditure can be recovered when the radio devices in question are sold. The legal regulation does not mean that citizens are forced to purchase a new device. Moreover, the regulation only applies to high-end devices. There will be no administrative compliance costs.
