5. Order issued pursuant to Article R. 522-16 of the Environmental Code and relating to the conditions for using certain categories of biocidal products

8. The Order defines certain conditions for using biocidal products, especially regarding the use of the necessary personal protective equipment for their use, storage procedures and any usage restrictions relating to the prevention of any poisoning of non-target species.

9. Since 1 July 2016, pursuant to Law No 2015-1567 of 2 December 2015, marketing authorisations for biocidal products, hitherto granted by the Ministry of the Environment, have been issued by the French Agency for Food, Environmental and Occupational Health & Safety.
In this context, the provisions of the Environmental Code have changed as a result, and now state that ‘the conditions for using certain categories of biocidal products [may] be established by a joint Order of the Ministers for the Environment, Labour and Health, with a view to ensuring the effectiveness of these products and preventing the potential human health and environmental risks likely to arise from these activities’.
This Order thus lays down a certain number of these conditions for use.
