6. The Order concerns Danish rules on the registration of vehicles to the Danish Vehicle Register, including vehicles which are hired.

8. The Order regulates when and how vehicles are to be registered in Denmark. The regulation is an administrative regulation which may be issued by the Ministry of Taxation on the basis of the Act on the registration of vehicles.

The amendments to the Order concern a partial implementation of Directive (EU) 2022/738 of 6 April 2022 (the Hired Vehicles Directive), the implementation of which is deemed to have to be notified.

The substantive changes in the Order forming the basis of the notification are incorporated in Section 16 of the Order as a new Section 16(2).

Other amendments that are not related to the Hiring Directive and which are not considered relevant to the notification are Sections 15, 38(5), 74(6), 76(1), 91(2), No 3, and 108(4).

The Order has already been notified in accordance with the Information Procedure Directive.

9. Directive (EU) 2022/738 of 6 April 2022 (the Hired Vehicles Directive) concerns the extended possibility to use vehicles for the carriage of goods which are hired out to transporters. These vehicles are referred to as ‘hired vehicles’.

At the same time, however, for tax reasons, the Directive allows Member States to require foreign-registered hired vehicles hired by national transporters to be registered in accordance with its national registration rules after at least 30 days, which the Ministry of Taxation wishes to make use of. In addition, the Directive also allows the use of foreign-registered hired vehicles hired by national transporters to be restricted to drive for hire or reward. The Ministry of Taxation also wishes to make use of this option.

Today, the Order has similar rules to what is being implemented, but it is assessed that it is necessary to have separate rules for hired vehicles. Therefore, the Ministry of Taxation wants to take advantage of these two restrictions. These parts are therefore incorporated into Section 16 of the draft.

The other amendments are not related to the partial implementation of the Hired Vehicles Directive and are therefore not considered relevant for the purposes of this notification.

The draft for a new Order on the registration of vehicles is attached. The new Order replaces the existing Order No 2523 of 15 December 2021.

The new provision of the draft Order in Section 16(2) is based on Consolidation Act No 179 of 22 February 2023, on the registration of vehicles, Section 5.

The Order will also be notified in accordance with Article 2(2) of Directive (EU) 2022/738 of 6 April 2022. (the Hired Vehicles Directive).
