This draft is the regulatory framework that lays down the essential concepts and requirements to be met by structures located in seismic zones in Spain, in addition to compliance with the rest of the specific regulations in force regarding structures, so that their behaviour, in the face of seismic phenomena, avoids serious consequences for the health and safety of people, avoids economic losses and promotes the preservation of basic services for society in cases of high-intensity earthquakes.
The draft Royal Decree consists of the articles and six annexes (each of which is attached for uploading to the TRIS platform as a separate file).

9. This draft was previously notified on 23/03/2023 (reference 2023/0132/E), but due to an error in the way of uploading part of the project to the TRIS platform (Annexes I to VI), it is again notified, without any change in its content.
Update the current regulations relating to the seismic design of structures in order to adapt them to ongoing new needs and technical progress.

— Extend the scope of the Earthquake-Resistant Construction Standard to include structural types not explicitly covered to date, such as: towers, masts, chimneys, silos, tanks, pipes, containment structures and their foundations, as well as the geotechnical design for seismic actions.

— Regulate other aspects that are not covered (or are only very briefly covered) by the current regulation, such as: the design and verification of non-structural elements subjected to seismic actions; the classification of structural elements into primary and secondary seismic elements; the earthquake-resistant assessment and adequacy of existing buildings; and the project of structures with base insulation.

— Make this regulation a technical framework consistent with that established in the Structural Code (adopted by Royal Decree 470/2021, of 29 June 2021) and in the Technical Building Code (adopted by Royal Decree 314/2006, of March 17 2006), which incorporate the most relevant aspects of European legislation for the calculation of structures, in accordance with the procedures established in the structural Eurocodes.

In relation to the draft royal decree for the approval of the Spanish Seismic Construction Standard (NCSR by its acronyms), published on the EU-TRIS website, we would like to make the following considerations:

Technical questioning of the regulation by the professional sector

Since the public consultation process for the NCSR began in Spain in March 2022, this regulation has been highly questioned in the professional and academic world. The NCSR received much criticism in the public information period in Spain, throughout the year 2022, without these pertinent allegations having been taken into account in the final draft. These allegations have not been included in the documentation uploaded to TRIS "Treatment of Comments and Observations Received", where they are just mentioned, but not detailed as they should.

Due to the decision of the Ministry of Transport to go on with the royal decree, and considering the alarm that this decision has generated, during the last months there has been a professional mobilization of the sector that has been supported by practically all the professional associations related to structural and geotechnical engineering, dozens of structural university professors, consulting and construction firms and hundreds of experts (see Annex A, Manifesto for a coherent and safe seismic regulation is attached with the endorsements).

The main criticism made has been the lack of technical coherence of the regulatory text, leading to important risks for the safety of buildings and infrastructures and, therefore, for the safety of people. This lack of coherence is mainly due to the fact that NCSR has been drafted as an altered copy of Eurocode 8, in which the system of cross references between the different Eurocodes has been eliminated and replaced by other technically unjustified references (either to another national regulation that is not compatible with the Eurocodes, or leaving the issue open to the responsibility of the designer).

This regulatory problem has received an important attention in the press and social media in the last months, and has emerged strongly again after the recent earthquake of September 9th in Morocco (see Annex B, Summary of press references).

Impediments to the free circulation of products and services

Some of the Spanish structural regulations of the last decade include a clause with a certain recognition of the Eurocodes (although partial and incomplete), however this is not the case with NCSR which does not recognize at all the possibility of using the Eurocodes as a valid alternative to itself.

We consider this an unacceptable setback, which undoubtedly represents a barrier to the free movement of professionals, services and products within the EU.

If this Seismic Resistant Construction code came into force, a structural or geotechnical project fully developed with Eurocodes will be rejected in Spain for not complying with this regulation. Although the NCSR largely reproduces the content of Eurocode 8 (EN 1998), it incorporates small but numerous alterations to the text of EN 1998 that, in practice, lead to different results in the calculations. “The disparities between the various calculation methods referred to in national building regulations hinder the free circulation of engineering and architectural services within the Community” (Commission Recommendation 2003/887/EC of 11 December 2003 on the implementation and use of Eurocodes for construction works and structural construction products).

Taking into account that the EU countries bordering Spain, Portugal and France, have directly adopted Eurocode 8, the issue of calculation disparities becomes especially striking in the case of cross-border projects, giving rise to technical difficulties and potential contradictions.

In the same way, in relation to the free movement of products, a precast concrete element with CE marking (harmonized standards EN 13225 and EN 15050) will be rejected in Spain in the seismic areas (a large part of the country). One of the reasons for this are the additional ductility properties required by NCSR (regarding the properties required by EN 1998) to the reinforcing steel used in structures under seismic actions. A detailed explanation of this serious matter is in Annex C.

Intellectual property rights violation

As said, NCSR is a copy of EN 1998 that changes all references to EN standards. Therefore, clear and undoubtedly, NCSR is a copy of a European EN standard.

The risk of violation of copyright was made clear at national level by some members of the National Seismic Commission (CPNS), during the elaboration of the regulation, requesting that a dictum from the State Legal Service should be demanded. This request was not attended to by the CPNS. Regulatory Impact Analysis Report (March 21st 2023, page 106) contains a mention of the matter. However, the explanation given by the Spanish authorities, included in such Report, does not clarify it from a legal point of view, it just argues that “no claim has been received” (see Annex D).

To show the very high level of coincidence between the text of the NCSR and the text of the UNE-EN 1998, some samples of NCSR vs UNE-EN 1998 have been tested with some text comparison software for plagiarism detection used in academia. Results show that differences are mainly in crossed references (see Annex D) and that the percentages of plagiarism are extremely high.

Request

In regard of the situation above explained, we claim to the EU authorities to do not accept the draft of the Spanish Seismic Resistant Construction regulation considering:

- There is a strong criticism among the Spanish professionals against NCSR.

- NCSR does not recognize EN 1998 (applied together with the rest of the Eurocodes to which it is complementary) as a valid standard for earthquake-resistant construction and, therefore, it constitutes a barrier to the free circulation of products and engineering/architectural services.

- The regulation violates the intellectual property of a CEN standard.

Asociación Caminos

The Association of Civil Engineers was created in 1903 to represent its members in all kinds of actions and foster their union and spirit of collaboration.

The AICCPIC is private in nature and has a national dimension. The Association of Civil Engineers promoted the creation of the Institute of Engineering (1905), as well as the College of Civil Engineers, Canals and Ports (1953).

Manifesto for a coherent and safe seismic regulation

MANIFIESTO

DE LA ASOCIACIÓN DE INGENIEROS DE CAMINOS, CANALES Y PUERTOS

Y DE LA INGENIERÍA CIVIL

Por una normativa sísmica

coherente y segura

En el año 2011, en que tuvo lugar el terremoto de Lorca, ya era reconocido entre los expertos que la normativa española de cálculo frente a terremotos, la NCSE del año 2002, necesitaba una revisión profunda. En 2016, la Comisión Permanente de Normas Sismorresistentes aprobó por unanimidad una nueva norma sísmica (NCSR-16) que remitía directa e íntegramente al Eurocódigo 8. Sin embargo, la NCSR-16 nunca vio la luz. Tras siete años de vacilaciones, en marzo de 2023, la Comisión Permanente de Normas Sismorresistentes ha aprobado sin unanimidad en esta ocasión una nueva norma, la NCSR-23, que modifica sustancialmente la NCSR-16 al sustituir la remisión directa e íntegra al Eurocódigo 8 por una transcripción alterada del mismo que rompe el sistema de referencias cruzadas ente los distintos Eurocódigos. El sistema de referencias entre Eurocódigos constituye un elemento troncal de los mismos, esencial para asegurar la coherencia de este conjunto indivisible de normas.

La nueva Norma NCSR-23 ha recibido críticas de fondo por parte del mundo académico, instituciones, asociaciones profesionales, proyectistas e incluso por parte de algunos órganos de la Administración. La Asociación de Ingenieros de Caminos, Canales y Puertos y de la Ingeniería Civil ha recogido la gran inquietud existente en la profesión por la falta de coherencia técnica de la NCSR-23,con los consiguientes riesgos para la seguridad de los edificios e infraestructuras y, lo más importante, para la seguridad de las personas en caso de que tenga lugar un terremoto. El proyecto de Real Decreto para la aprobación de la NCSR-23 se encuentra actualmente en el periodo de statu quo en la Comisión Europea, paso previo a su aprobación por el Consejo de Ministros. Con este MANIFIESTO se busca que el Gobierno, en el ejercicio de sus competencias, disponga el uso de los Eurocódigos en su integridad para los proyectos de edificación y obra civil y, en todo caso y hasta que este hecho se produzca, retire el proyecto de Real Decreto de aprobación de la NCSR-23.

Los Eurocódigos

Los Eurocódigos son un conjunto de normas para el proyecto estructural y geotécnico, redactadas por el Comité Europeo de Normalización (CEN) bajo mandato de la Comisión Europea, que constituyen un cuerpo normativo coherente e indivisible. Desde hace ya más de una década, los Eurocódigos se utilizan como normas de proyecto en la gran mayoría de países europeos, e incluso en otros países fuera de Europa.

Han sido desarrollados para permitir que el proyecto de las obras de edificación y de ingeniería civil cumplan con el Requisito Básico RB1 (resistencia mecánica y estabilidad), parcialmente con el Requisito Básico RB2 (seguridad en caso de fuego) y con el Requisito Básico RB4 (seguridad de uso) del Reglamento de Productos de Construcción UE/305/2011.

La aplicación de los Eurocódigos en los Estados miembro de la UE respalda la Directiva 2006/123/CE del Parlamento europeo y del Consejo, de 12 de diciembre de 2006, sobre servicios en el mercado interior ("Directiva de servicios"), al evitar que las disparidades en los métodos de proyecto y cálculo de las normas nacionales de construcción constituyan un obstáculo a la libre circulación de los servicios de ingeniería y arquitectura dentro de la Unión Europea.

Por otro lado, para los contratos públicos de construcción y de servicios de ingeniería relacionados, la Directiva 2014/24/UE del Parlamento europeo y del Consejo, de 26 de febrero de 2014, sobre contratación pública, establece que los poderes adjudicadores deben permitir en sus licitaciones el uso de normas europeas.

Los reglamentos españoles

Aunque hace más de una década que la práctica totalidad de los países europeos ha abandonado la redacción de códigos estructurales nacionales y han adoptado los Eurocódigos, en España se siguen emitiendo reglamentos alternativos a dichas normas.

El Código Técnico de la Edificación, el Código Estructural, la Norma Sismorresistente y las Instrucciones de Bases de cálculo y Acciones en puentes continúan reeditándose y siguen siendo de obligado cumplimiento en territorio español.

La razón que el Ministerio de Transportes, Movilidad y Agenda urbana invoca para mantener esta forma de proceder es la inviabilidad jurídica de la simple remisión directa a los Eurocódigos en un reglamento español.

Sin embargo, en la sesión de debate sobre la NCSR organizada por la Asociación Caminos el pasado 18 de abril, se puso de manifiesto que, tal como ha sido señalado por el Tribunal Supremo y por el Consejo de Estado, la “técnica del reenvío”,mediante la cual los reglamentos “remiten a las normas o especificaciones técnicas aprobadas por entidades y organizaciones privadas de normalización”, es decir, sin incorporar su contenido al reglamento, “es admisible en nuestro ordenamiento jurídico”, lo que invalida el argumento sostenido por el MITMA.

La problemática técnica de la NCSR

La NCSR-23 transcribe el Eurocódigo 8 “Proyecto de estructuras resistentes al sismo”, un texto de más de 600 páginas, eliminado las 430 referencias que esta norma contiene a otros Eurocódigos, a los que complementa para el proyecto frente a sismo y que constituyen un cuerpo único e indivisible.

Estas referencias técnicas, que son imprescindibles para asegurar la coherencia interna del conjunto normativo y, por tanto, para la seguridad de las construcciones, han sido sustituidas una a una por referencias a otros reglamentos técnicos españoles o, a falta de estos, simplemente eliminadas, dejando la cuestión abierta a la libre decisión del proyectista, lo que resulta de extrema gravedad desde el punto de vista de la seguridad de las personas y las construcciones.

La labor de cambio de referencias se ha llevado a cabo con criterio “editorial”, sin la intervención de verdaderos especialistas en el proyecto sísmico y estructural y sin efectuar estudios técnicos y análisis comparativos para analizar las implicaciones de los cambios y avalar su congruencia. Es un principio técnico básico que diferentes cuerpos normativos no pueden ser entremezclados. En este caso, subyace el hecho agravante de que el Eurocódigo 8 utilizado como base tiene más de 20 años de antigüedad y va a ser reemplazado a nivel europeo en los próximos 2 o 3 años, lo que daría lugar a que la norma española naciera obsoleta ya de origen.

Tanto el procedimiento de elaboración como la norma resultante han sido duramente criticados por los expertos, que, con criterio técnico, rechazan abiertamente la NCSR-23. Aun así, en marzo de 2023, la Norma Sismorresistente española ha sido aprobada en la Comisión Permanente con serias discrepancias internas y sin contar con la unanimidad que debería exigirse en un texto de este alcance.

Es posible una solución

La solución está al alcance de la mano. Somos Europa y la aplicación directa de los Eurocódigos no puede estar obstaculizada en España. Debemos aprovechar la importantísima inversión hecha a nivel europeo (con notable participación española) en la redacción de este conjunto de normas, coherente e indivisible, y favorecer su aplicación. Es únicamente cuestión de voluntad que los Eurocódigos se apliquen en nuestro país, como se hace en el resto de Europa. El turno rotatorio de Presidencia española que va a dar comienzo podría ser un momento oportuno para dar el paso.

El ejemplo más próximo lo tenemos en Portugal, país con una situación reglamentaria en el campo estructural muy similar a la española, que en julio de 2019 emitió un Decreto-Ley que establece como obligatorio el uso de los Eurocódigos en su conjunto, abandonando los reglamentos estructurales previos.

Conclusión

La Asociación de Ingenieros de Caminos, Canales y Puertos y de la Ingeniería civil ha recogido la profunda inquietud existente en el mundo de la ingeniería por la falta de coherencia técnica del conjunto reglamentario español en el campo estructural y geotécnico, que ha alcanzado su máxima expresión en la Norma de Construcción Sismorresistente (NCSR-23), cuya elaboración se ha efectuado:

sin respetar el criterio científico
sin los avales técnicos necesarios
sin atender a las alegaciones de los especialistas
rompiendo la coherencia técnica de la normativa que transcribe
dejando abiertas a criterio del proyectista cuestiones bien resueltas en normas europeas
evitando la remisión directa a los Eurocódigos a pesar de ser jurídicamente viable de acuerdo con el Tribunal Supremo y el Consejo de Estado
sin unanimidad en la Comisión Permanente de Normas Sismorresistentes

Dada la enorme trascendencia que este conjunto reglamentario tiene sobre la seguridad de los edificios y las infraestructuras de nuestro país y, por ende, sobre la seguridad de los ciudadanos, con este MANIFIESTO se insta a que el Gobierno, en el ejercicio de sus competencias:

retire el proyecto de RD de aprobación de la NCSR-23
elabore un nuevo RD disponiendo el uso de los Eurocódigos de forma directa y global, para que estas normas sean aplicadas en España como se hace en el resto de Europa

Pedimos al Gobierno de la nación que trate este asunto con la visión de conjunto y amplitud de miras que un tema de esta importancia requiere.

Annex C

HINDERING OF THE FREE CIRCULATION OF PRECAST ELEMENTS

Introduction

According to NCSR, in the critical zones (zones where plastic hinges may form) of high ductility buildings and bridges designed and built according to this regulation, reinforcing steel with properties corresponding to an SD[1] ductility class must be used. The requirements to be met by a reinforcing steel class SD are defined in the Spanish regulation Código Estructural that uses UNE 36065 as reference standard. On the other hand, the European standard, Eurocode 2 (EN 1992-1-1), has EN 10080 as reference standard for reinforcing steel, i.e., the reinforcing steel of any construction product with CE marking will meet the requirements stablished by Eurocode 2 and EN 10080.

UNE 36065 and EN 10080 coincide in most of the requirements for reinforcing steel, however, UNE 36065 requires some additional ductility characteristics not required by EN 10080.

As the requirements stablished for a reinforcing steel with ductility class SD (according to UNE 36065) are more demanding than those required for a reinforcing steel specified according to EN 10080 (according to the Eurocodes), an element that includes reinforcing steel, fabricated in any European country and with a CE marking might not be accepted in Spain; this could be the case of precast concrete elements, regulated by harmonized standards EN 13225 and EN 15050.

This difference between the requirements demanded by UNE 36065 and EN 10080 could hinder the free circulation of precast concrete elements, against the objectives stablished in the Comission Recommendation of 11th December 2003 on the implementation and use of Eurocodes for construction works and structural construction products.

Mandatory use of class SD reinforcing steel by NCSR

According to the clause 5.5.1.1(3) of Annex 1 of NCSR, in high ductility buildings designed and built according to this regulation, reinforcing steel with properties corresponding to an SD ductility class must be used. SD is the highest ductility class specified by the Spanish regulation (see next section 3).

Clause 5.2.1(1)P of NCSR-Annex 2 (Bridges) defines an analogous criterion for bridges: “In bridges designed for ductile behavior with q > 1,5, concrete members where plastic hinges may form, shall be reinforced with steel of Class SD in accordance with articles 34 and 35 of Código Estructural.”

The European standard, EN 1998, also demands the highest ductility class for critical regions of high ductility buildings and bridges. Clause 5.5.1.1(3)P of EN 1998-1 stablishes that “In critical regions of primary seismic elements, reinforcing steel of class C[2] in Table C.1 of EN 1992-1-1:2004 shall be used. C is the highest ductility class specified by the European standard (see next section 3).

Clause 5.2.1(1)P of EN 1998-2 defines an analogous criterion for bridges: “In bridges designed for ductile behaviour with q > 1,5, concrete members where plastic hinges may form, shall be reinforced with steel of Class C in accordance with EN 1992-1-1:2004, Table C.1.”

Properties of class SD and class C reinforcing steel

Class SD and Class C are the highest ductility classes defined by the Spanish regulations and European standards, respectively.

The properties of the ductility class C are defined in Annex C of EN 1992-1-1:

The properties of the ductility class SD are defined in article 34 of the Spanish regulation, Código Estructural:

While EN 1992-1-1 (and EN 10080) specifies the reinforcing steel by the definition of the yield strength (in Figure 4, Límite elástico), the minimum value of k=(fs/fy)k (in Figure 4, Relación fs/fy) and the characteristic strain at maximum force, euk, (in Figure 4, Alargamiento total bajo carga máxima), Código Estructural (and UNE 36065), in addition to those required by Eurocode 2, demands the definition of two additional ductility properties (red squares in Figure 4):

CE marking of precast concrete products

Precast elements commercialized in Europe must have CE marking, as EN 13225 Precast concrete products - Linear structural elements and EN 15050 Precast concrete products – bridge elements are harmonized standards. These standards establish the requirements, the basic performance criteria and the evaluation of conformity of precast linear elements such as columns, beams and frame elements and elements used in bridge construction, respectively.

Annex ZA of both standards refer to EN 13369 Common rules for precast concrete products as the reference standard for the definition of the reinforcing steel properties.

Finally, EN 13369 stablishes that reinforcing steel (bars, coils and welded fabric) shall comply with EN 10080.

As it can be seen in Figures 5 to 8, the reinforcing steel of a precast concrete element with CE marking will comply with the requirements of EN 10080 and EN 1992-1-1.

Barrier to the free circulation of products

Even though a precast concrete element is fabricated with areinforcing steel with the highest ductility class stablished by Eurocode 2 and fulfils all the requirements for the CE marking it would not be accepted in Spain, as NCSR requires the use of SD reinforcement, defined according to the Spanish regulation Código Estructural that requires additional properties.

The difference between the requirements set by the Spanish regulations (NCSR + Código Estructural) and the European standards (EN 1992-1-1 and EN 10080) would prevent the use in Spain of precast elements with CE marking, which is against the EU legislation.

The draft royal decree for the approval of the Spanish Seismic Construction Standard NCSR, is a dangerously altered copy of EN 1998 that eliminates or changes the 435 references of this Eurocode to other Eurocodes by references to Spanish codes that are incompatible with the Eurocodes. I claim to the EU authorities to do not accept the drat of the Spanish Seismic Resistant Construction regulation due to the following reasons:

1.- The draft lacks technical coherence leading to important risks for the safety of buildings and infrastructures and, therefore, for the safety of the people of the EU and other people outside the EU that could be in EU during a severe seismic event. This draft has already produced alarm, social unrest and a general rejection from hundreds of experts, consulting and constructions companies. The media (TV, radio and newspapers) have reported this unrest and rejection in the last months. Further, university professors, engineers, architects, professional associations, consulting and construction firms related to structural and geotechnical engineering signed a “Manifesto for a coherent and safe seismic regulation” strongly against the draft of NCSR. We do not want in Europe to see the dramatic consequences of earthquakes that we saw recently in Turkey, for example. We claim the Spanish Government to adopt directly all Eurocodes, without any change or modification, since this is the only way to guarantee in Spain a level of safety equal to that of other European countries that have adopted Eurocodes.

2.- The draft produces clear impediments to the free circulation of services and products within Europe. Regarding the free circulation of services: (1) structural or geotechnical projects fully developed with Eurocodes will be rejected in Spain for not complying the Spanish regulation; (2) NCSR does not recognize at all the possibility of using the Eurocodes as a valid alternative to itself; (3) NCSR incorporates numerous alterations to the original text of EN 1998 that lead to different results in the calculations. It is worth recalling the Commission Recommendation 2003/887/EC of 11 December 2003 on the implementation and use ofEurocodes for construction works and structural construction products that clearly states: “The disparities between the various calculation methods referred to in national building regulations hinder the free circulation of engineering and architectural services within the Community”. As for the free circulation of products, for example, a precast concrete element with CE marking (harmonized standards EN 13225 and EN 15050) will be rejected in Spain in seismic areas (a large part of the country) because it does not fulfill the additional ductility properties required by NCSR to the reinforcing steel.
