5. Preliminary draft law amending the Law of 7 May 1999 on games of chance, betting, gambling establishments and the protection of players

8. The notification concerns only the following articles:
- Article 8: 1) It removes the authorisation given to the King to lay down specific advertising rules for applicants for an additional licence in view of Article 61 paragraph 2 of the Law which gives a general authorisation to the King to regulate the modalities of advertising for games of chance. 2) The article gives a legal existence to the list of illegal websites, commonly referred to as the “black list”, of the Gambling Commission.
- Article 11: class A, A+, B, B+, F1+ and F2 licensees are required to identify any person who enters the gambling establishment for the purpose of gambling or who wishes to participate in gambling, including online gambling.
- Article 13: it relates to the creation of the EPIS system, in order to comply with the rules of the GDPR. These are not new rules, but simply a way of complying with the GDPR. EPIS is the Excluded Persons Information System, i.e. the central system for the processing of information concerning persons referred to in Article 54 of the Gambling Act;
- Article 16: This article concerns the back-up register, which is a temporary register of players who are present in the gambling establishment or who are taking part in a game of chance in the event that, for any reason beyond the control of the licensee, it is impossible to consult EPIS.

This preliminary draft law aims in particular to enshrine in the Law the various databases of the EPIS (Excluded Persons Information System) system, to ensure that the application complies with the GDPR (following the order of the Namur Court of First Instance of 17 January 2023). The preliminary draft also aims to modernise and simplify the Gambling Act. These changes also apply to licensees who allow games of chance to be operated using information society instruments. All the measures are aimed at strengthening the protection of players, in particular those excluded from gambling under Article 54 of the Gambling Act.
