8. The draft Regulation sets the rates of the fee to pay the costs of handling waste generated from single-use plastic products in the amount of:
1) PLN 0.10 per 1 kg of: food containers, packages and wrappers, beverage containers up to three litres, drinking cups and light plastic shopping bags.
2) PLN 0.01 per piece of tobacco products with filters containing plastics and of filters containing plastics sold for use with tobacco products.
3) PLN 0.01 per piece of wet wipes and balloons.

The need to set the rate of the annual fee is related to the transposition of the provisions of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment (OJ EU L 155, 12.6.2019, p. 1) into national law with regard to the extended producer responsibility referred to in Article 8 of the Directive concerning the products referred to in Annex E to the Directive.
The purpose of the fee in respect of products such as food containers, packages, and wrappers, beverage containers up to three litres, drinking cups, light plastic shopping bags, tobacco products with filters, and filters containing plastics sold for use along with tobacco products is to pay the costs associated with the collection of waste generated from products of the same type as those placed on the market, left in public waste collection systems, including the fee to pay the costs of setting up and maintaining those systems as well as the cleaning, transporting, and treatment of waste generated from products of the same type as waste generated from products that have been placed on the market.
For products such as wet wipes and balloons, the annual fee shall be to pay the costs of cleaning up, transporting, and treating waste generated from products of the same type as waste generated from the products that have been placed on the market.
In the case of single-use plastic products such as wet wipes, balloons, tobacco products with filters containing plastics, and filters containing plastics sold for use along with tobacco products, products pre-packed in unit packs intended to transfer the product to the user at the place of purchase shall be considered as unit products.
