Directive (EC) N° 94/62 on packaging and packaging waste
A recent decision to defer the introduction of the UK's proposals for Extended Producer Responsibility (EPR) for packaging and the corresponding regulations to the end of 2024 has meant that the current packaging producer responsibility regime will continue to the end of 2024.
The packaging recycling targets in the current regulations expire at the end of 2023 so these new regulations have been brought forward to introduce recycling targets for Northern Ireland for 2024. The Packaging and Packaging Waste Directive requires a specified minimum recycling rate to be achieved by 2025 and 2030 until such time as the Directive is amended. The new targets will ensure that Northern Ireland remains on the trajectory to meet the targets specified in the Directive.
Due to the very recent decision to defer our EPR regulations for one year and the need to consult stakeholders on the proposals, the regulations which introduce these targets and which we are notifying have been made and are due to come into force on 1st January 2024. This is to ensure targets are in place on time, providing clarity and certainty to stakeholders, and on the understanding that the equivalent regulations in England, Scotland and Wales are to be made and come into force at a similar time. However, we will still review and take appropriate action if any comments are received pursuant to this notification within the usual 3-month standstill period.

8. Amendment of Schedule 2 to the Producer Responsibility Obligations (Packaging Waste) (Northern Ireland) Regulations 2007. The changes are to introduce new recycling targets for glass, plastic, paper/board, wood, steel and aluminium individually and an overall recycling target for 2024.

9. The recycling targets for these materials, as well as the overall recycling target, expire at the end of 2023, and there are currently no targets set in legislation in Northern Ireland for 2024. The Packaging Directive requires a specified minimum recycling rate to be achieved each year until such time as the Directive is amended. The notified instrument is therefore necessary to introduce packaging target requirements in Northern Ireland for 2024.
