Amendment of the recently decided TSFS 2023:37 on transport of long indivisible loads, which contains provisions allowing transport on roads that are not private roads with long indivisible loads despite the provisions in Chapter 4, Section 17, first paragraph of the Traffic Ordinance (1998:1276). In addition to a linguistic and consequential amendment of transitional provisions, they contain an addition that means that signs under Section 12 may be both E-labelled under ECE Regulation 104 and ECE-Regulation 150, instead of just 104 c.

The draft does not include a mutual recognition clause since it does not contain provisions that would make a clause relevant.

The proposal concerns Council Directive 96/53/EC but does not go beyond the obligations arising from that Directive.

9. According to the current regulations, signs under Section 12 must be E-marked in accordance with ECE Regulations 104 Class C. Materials according to Class C are not intended to be used for whole vehicle signs, but primarily to mark out the outer contours of heavy goods vehicles and lorry trailers through retro-reflective strips. In practice, it is possible to manufacture vehicle signs with strips according to ECE Regulations 104 Class C, but this entails an extensive changes for the sign manufacturer

ECE Regulations 104 have been replaced to some extent by ECE Regulations 150, which will eventually replace Regulation 104 in full. Today, it is not possible to have new retro-reflective materials type-approved under Regulation 104. This may in the long term mean that it will not be possible to manufacture plates complying with the requirements of the regulations on marking according to ECE Regulations 104 Class C. The amendment ensures that there will be suitable plates compatible with applicable regulations, marking the wide load of vehicles and road trains.
