The draft Order proposes to establish a system of criteria to ensure proper pre-treatment and recycling of inert construction waste, to impose an obligation to have a quality management system, to apply permitted processes and methods for the recovery of the waste, which could lead to the waste ceasing to be considered as waste, but as a construction product. These requirements will apply to construction waste treatment activities and to the supervision of these activities by public authorities.
Main requirements
- Recycled inert construction waste, as referred to in sub-paragraph 1.1 of Annex 1 to the Regulations, as proposed for adoption in the draft, shall no longer be considered as waste if it meets all the criteria set out in that Annex.
- The granular material obtained from mechanically recycled waste referred to in sub-paragraph 1.1 of Annex 1 to the Regulations approved under the draft (recycled construction product) is one of the construction products referred to in point 1 of the List of Regulated Construction Products approved by the Order of the Minister of the Environment of the Republic of Lithuania of 24 January 2022, No. D1-15 approving the List of Regulated Construction Products.
9. EU-level documents and strategies set ambitious targets to reduce the extraction of new raw materials and to maximise recycling and reuse. In the construction sector, this means encouraging the use of recycled construction waste, of construction products that meet the applicable standards, and of properly sorting the waste generated during construction work. The cases of improper recycling and misuse of construction waste, which have come to light during the supervision of the activities of economic operators by the State Environmental Inspection officers, as well as the low demand for construction products made from recycled construction waste on the market for construction products, show that the general criteria for declassification of waste laid down in the Waste Management Act are not sufficient to ensure that recycled construction waste is properly recycled and is justifiably regarded as a product.
The draft was prepared on the basis of an evaluation study commissioned by the Ministry of Environment on the evaluation of the use of construction waste, good practices of other European Union countries and in order to ensure a clearer and more transparent regulation of end-of-waste construction waste.
