8. The draft makes adjustments to the licensing scheme to identify persons with specialised knowledge; these are the persons who are allowed to purchase certain types of powerful fireworks. This is an existing obligation based on Directive 2013/29/EU of 12 June 2013 on the harmonisation of the laws of the Member States relating to the making available on the market of pyrotechnic articles, which was then transposed into the Royal Decree of 3 March 2010 on the placing on the market of pyrotechnic articles.

The current draft shall provide a clearer framework and is necessary to align these authorisations with the Benelux decision of 7 December 2020 of the Benelux Committee of Ministers on the introduction of a pyro-pass, as amended by the Benelux Decision of 27 September 2022.

9. The Benelux Decision of 7 December 2020 of the Benelux Committee of Ministers on the introduction of a pyro-pass, as amended by the Benelux decision of 27 September 2022, aims to create a clearer regulatory framework for persons with specialised knowledge as referred to in Directive 2013/29/EU.

In order to limit the possibilities for misuse of hazardous pyrotechnic articles, a uniform document, the pyro-pass, which serves as a permit and which shall have the same form and content in all Benelux countries, shall be introduced. A system is also provided for the firework dealers to carry out an online verification of the licence.
