Directive (EC) N° 94/62 on packaging and packaging waste
Since preparation and notification of the Producer Responsibility Obligations (Packaging Waste)(Amendment) Regulations (Northern Ireland) 2023 which introduce recycling targets for Northern Ireland for 2024 and which are due to come into force on 1st January 2024, we have been made aware that the glass re-melt target for 2024, which is a sub target of the glass target, has been omitted. This is an amending SI, which adds in that target.

Due to the recent decision to defer the UK packaging EPR regulations for one year and the need to consult stakeholders on the proposals, this regulation has been made and is due to come into force on 1st February 2024. This is to ensure the re-melt target is in place as soon as possible, providing clarity and certainty to stakeholders, and on the understanding that the equivalent regulations in England and Wales, and in Scotland (with the re-melt target) have been made and come into force on 1st January 2024. However, we will still review and take appropriate action if any comments are received pursuant to this notification within the usual 3-month standstill period.

8. Amendment of Schedule 2 to the Producer Responsibility Obligations (Packaging Waste) Regulations (Northern Ireland) 2007. The change introduces a glass re-melt target for 2024.

Due to an oversight, the glass re-melt proportion target for 2024 was omitted from the Producer Responsibility Obligations (Packaging Waste) (Amendment) Regulations (Northern Ireland) 2023, and a further amendment is required to ensure that targets in NI are in line with targets in England and Wales and in Scotland. Whilst this is a sub-target to the glass recycling target which is not specifically required under the Packaging Directive, we are notifying this amendment on the basis that it relates to targets and the Directive requires a specified minimum recycling rate to be achieved each year until such time as the Directive is amended.
