The draft provides for an obligation for producers who place fishing gear containing plastic on the market to register themselves or their representative in a producer register, including registering certain information, cf. Sections 3 to 9 of the draft. Producers are also required to pay a fee for registration, cf. Section 39(1) of the draft.

The draft also provides for the obligation for producers to report information on quantities of fishing gear containing plastic placed on the market (or expected to be placed on the market) as well as certain information on quantities of end-of-life fishing gear containing plastic that have been taken back and waste-treated, cf. Sections 25-29 of the draft. Reports shall be made to the organisation responsible for the producer register (Dansk Producentansvar).

The draft also provides that collective schemes must be set up in the producer register in order for the obligations of producers, as referred to in Section 30(1) of the draft, to be transferred to the collective scheme, cf. Section 32(1) of the draft.

‘Producer’ is defined in Section 2, No 16, of the draft. ‘Collective schemes’ are defined in Section 2, No 9, of the draft.

In addition, the draft contains provisions on producers’ collection of fishing gear containing plastic, manufacturers’ security and self-monitoring, collective schemes and their self-monitoring procedure, information for end-users, fees for the allocation scheme and administration, Dansk Producentansvar’s retention of documents, Dansk Producentansvar’s and the Danish Environmental Protection Agency’s administrative cooperation, supervision, complaints and penalties.

9. The draft aims to introduce an extended producer responsibility for fishing gear containing plastic placed on the market in Denmark. The draft has been prepared in accordance with Article 8(8) of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment.
