5. Decision of the Flemish Government amending the Decision of the Flemish Government of 1 June 1995 laying down general and sectoral provisions on environmental hygiene, as regards plastic granules, fuels and flammable liquids, the storage of the
6. The amendments concern the conditions relating to plastic granules, fuels and flammable liquids, the storage of hazardous products and fuel tanks

8. The proposed amendments concern:
1° Insert general conditions for pollution control by
plastic granules;
2° the sectoral conditions relating to fuels and flammable liquids;
2° the sectoral conditions of storage of dangerous products;
3° the environmental conditions for private fuel tanks, which are not classified and which have a capacity of
less than 5000 kg.
Plastic granules can end up in the environment and aquatic systems at unintended losses along the chain (production, processing, logistics transport and recycling). This entails significant risks for people and the environment. Conditions to manage the risk of loss of plastic granules will be foreseen. The current proposal is a first step to reduce plastic granularity losses with mainly target requirements.
The storage of fuels and hazardous substances poses specific risks, including the possibility for soil contamination that is associated with significant clean-up costs. The preliminary draft decision includes urgent regulatory update including a number of preventive measures around private storage installations for fuel oil; the transformation of the research project into codes of good practice for the construction and control of solid holders for flammable liquids and dangerous products; and the partial conversion of the BAT study silage (road tanker station).
9. According to Article 1.2.1, §1 DBM, the aim of the Flemish environmental policy is to:
"1° management of the environment through the sustainable use of raw materials and nature;
2° Protection; against pollution and abstraction, of humans and the environment, and in particular of ecosystems which are relevant to the functioning of the biosphere and which relate to food supply, health and other aspects of human life;
3° Nature conservation and the promotion of biological and landscape diversity, in particular through the conservation, restoration and development of natural habitats, ecosystems and landscapes of ecological value and the conservation of wild species, in particular those endangered, vulnerable, rare or endemic."
Moreover, on the basis of a balance of interests between the various social activities, Flemish environmental policy aims at ensuring a high level of protection, based, inter alia, on the precautionary principle and the principles that preventive action should be taken, that environmental damage should as a priority be rectified at source, the standstill principle and the polluter pays principle.
Title II of the VLAREM (Decision of the Flemish Government of 1 June 1995 laying down general and sectoral provisions on environmental hygiene) contains, inter alia, the general and sectoral conditions applicable to classified establishments or activities.
The general environmental conditions apply to all classified establishments or activities. The sectoral environmental conditions apply to certain types of classified establishments or activities. These conditions aim to prevent and limit unacceptable nuisance and risks that the establishments and activities concerned might cause. Where appropriate, they also aim at remedying the damage caused by the exploitation of the facility or activity to the environment.
