The draft Law amending Article 2 of Law No IX-517 on the management of packaging and packaging waste and supplementing the Law with Article 8(3), drafted by the Seimas of the Republic of Lithuania, aims to consolidate certain actions and/or abstentions of natural and legal persons providing catering services in catering facilities with regard to the use of single-use plastic products (beverage containers and food containers, i.e. containers) referred to in points 1 and 4 of Annex 1(1) to the Law on the Management of Packaging and Packaging Waste (hereinafter referred to as ‘single-use plastic products’) in order to reduce it: 1) A ban on the free distribution of single-use plastic products to consumers; 2) Provision of alternatives to consumers (reusable packaging or single-use packaging not containing plastic or tableware) for single-use plastic products (Note: applicable when intended for on-the-spot use). 3) Ensuring that the cost of the alternative (reusable packaging or single-use packaging not containing plastic or tableware) for the consumer is not higher than that of a single-use plastic product (Note: applicable when intended for on-the-spot use). 4) Provision to the consumer of information on the conditions under which food or beverages may be purchased in packaging brought by the consumer in order to ensure safety and hygiene requirements (Note: applicable when intended for on-the-spot and take-away use). 5) Prohibition on the free distribution and/or sale of single-use plastic products by natural and legal persons providing mass catering services at mass events and in mass catering facilities on beaches, except where natural and legal persons providing mass catering services apply a deposit for single-use plastic products.

9. The main objective of the draft laws is to promote environmental awareness among consumers and businesses, reduce the use of single-use plastic products and environmental pollution (littering), increase the availability of reusable packaging and create incentives to create deposit systems for reusable packaging (beverage containers and food containers, i.e. containers).
The entry into force of the provisions of the draft Law amending Article 2 of Law No IX-517 on the management of packaging and packaging waste and adding Article 8(3) to the Law, would additionally (other measures were provided for at national level) contribute to the achievement of the objectives for 2026 laid down in Article 4 of Directive (EU) 2019/904 of the European Parliament and of the Council of 5 June 2019 on the reduction of the impact of certain plastic products on the environment.
