The above-mentioned Bill amends the (Ratifying) Law of 2004 on the Additional Protocol to the Convention on Cybercrime, concerning the criminalisation of acts of a racist and xenophobic nature committed through computer systems, (Law 26(III)/2004) and aims to enable the Court, at any stage of a police investigation conducted in connection with the commission of an offence specified in the basic law, on the basis of a unilateral request (ex parte) submitted by a police investigator at the order of the Chief of Police and upon approval of the Attorney General of the Republic, to order:

(a) the removal of websites hosting webpages with racist or xenophobic material and/or blocking access of users to such websites and webpages;

(b) blocking access to websites with racist or xenophobic material for internet users residing in the Republic of Cyprus.

The timely removal of illegal racist or xenophobic material on the internet and/or blocking of online access to such material, at the unilateral request of the police investigator, compensates for the difficulty faced in such cases by the prosecuting authorities in identifying the person who has posted the illegal material and thus the long period of time required for prosecution. By doing so, the dissemination of such illegal material is limited and the harm it causes is prevented or even mitigated.

The proposed amendment is a necessary measure to address the distribution and/or dissemination of illegal racist or xenophobic material via the internet. Technology currently provides various applications that allow the use of the internet anonymously. This may be exploited by people who may want to use it to create a hostile climate against specific groups of people, or to attract sympathisers.
