8. This draft Royal Decree implements an action in the Federal Action Plan for a Circular Economy, approved by the Council of Ministers on 17 December 2021. It implements the Law on promoting the repairability and durability of goods, which was passed by the House on 8 February 2024. This Royal Decree transforms the repairability index into a durability index for brands/models of televisions and washing machines that will be placed on the market after it enters into force.

The draft Royal Decree “aimed at determining the goods covered by the repairability index, the technical standards for establishing scores for each of the criteria and the method for calculating the repairability index” refers to washing machines and televisions among the goods for which a repairability index is to be calculated and communicated. An index of this type should allow consumers to inquire about the repairability of these devices. Consumers will, by being better informed about repairability, be more likely to acquire a device that has good repairability. The device concerned will therefore also be repaired more often.

On the other hand, a repairability index does not provide any information on the expected lifespan of a device. It may be that the repairability is just as good for two devices, but their expected lifespan is different because one device is more robust than the other.

For this reason, the Law on promoting the repairability and durability of goods provides that a repairability index can be transformed into a durability index. This durability index is not calculated solely on the basis of the repairability criteria of a device but also on the basis of criteria relating to the reliability of the appliance.

The Law also requires that the obligations applicable to the calculation of a repairability index or durability index for certain product groups be aligned as far as possible with what is developed in other countries. This will avoid creating an administrative burden because the obligations applicable in Belgium to calculate and report indices differ from those in other countries with a similar index. In France, regulations already provide for replacing, from a date to be determined, the repairability index of washing machines and televisions with a durability index for brands and models which will be placed on the market after the entry into force of that regulation.

This draft Royal Decree introduces identical rules for Belgium, so that the obligations applicable to the calculation and reporting of indices for washing machines and televisions are the same as in France and enter into force at the same time.

The draft Decree determines the method for calculating a durability index for washing machines and televisions, as well as the criteria to be taken into account for that calculation. These are the same methods and criteria as laid down in the French regulations. The draft Decree also sets out the responsibilities and obligations for calculating and communicating the durability index. They are modelled on the responsibilities and obligations that prevail for the repairability index.
