Implementation of Directive 94/62 obligations in Northern Ireland

8. Notification of draft Regulations as a whole as they improve the current producer responsibility system for packaging in Northern Ireland. The main focus is the implementation of Article 7(2) (Extended Producer Responsibility for packaging) of the Packaging and Packaging Waste Directive 94/62/EC in Northern Ireland which is in Part 6 (Disposal costs), the packaging waste recycling targets for 2025 to 2030 which are included in Schedule 5 (Recycling obligations), the labelling provisions in Part 3 (Recyclability assessments and recycling information), Chapter 2 (Recycling information)

9. The UK Government and Devolved Administrations of Northern Ireland, Scotland and Wales have ambitious goals to protect our climate, drive green growth, and drive down unnecessary waste. Our plans for Extended Producer Responsibility for packaging play a key part in delivering those goals. The current producer responsibility system for packaging has operated across the UK since 1997, but it has never placed the full costs of disposing of packaging waste on producers. Our requirements for Extended Producer Responsibility for packaging (EPR) will move the full cost of dealing with packaging waste from households away from local taxpayers and local councils to the packaging producers (applying the 'polluter pays principle'), thereby placing financial responsibility on producers for the costs of this packaging throughout its life cycle. The regulations provide for the Scheme Administrator to modulate the fees paid by producers to encourage the use of more environmentally sustainable packaging including packaging that can be recycled easily. Producers will also be expected to meet higher recycling targets and to apply clear unambiguous labelling to packaging to indicate if the packaging can be recycled or cannot be recycled to make it easy for consumers to do the right thing and dispose of packaging waste correctly. These regulations will implement extended producer responsibility for packaging in Northern Ireland.
