The purpose of the amendments is to improve the construction and technical rules and standards to ensure fire safety, to bring them into line with the international best practices and to remedy the shortcomings identified during the periodical study of the results of the implementation of Regulation No Ih-1971 of 2009 on construction and technical rules and standards to ensure fire safety.

9. The Regulation on construction and technical rules and standards to ensure fire safety in the event of fire is issued on the basis of Article 125(2) of the Ministry of Interior Act and Article 169(4) of the Spatial Development Act (SDA) by the Minister of Interior, jointly with the Minister of Regional development and Public Works, and it lays down the requirements and technical rules and standards for ensuring fire safety in the planning and property development of urbanised areas, the property development of land located outside urbanised areas, the design and execution of construction works in compliance with the provisions of SDA, reconstruction, major renovation, overhaul or change of the designated use of a site or part thereof, carrying out construction and installation works for which a building permit is required in accordance with Chapter Eight, Section III of the SDA, as well as the installation of mobile entertainment facilities and mobile establishments for commercial and other service activities pursuant to Article 56 of SDA, with the exception of mobile sites with flexible covering. The need to amend and to supplement Regulation No Ih-1971 of 2009 on construction and technical rules and standards to ensure fire safety derives from the need to refine the existing requirements for their unequivocal implementation by the participants in the investment process and the control bodies, and to achieve a balance between ensuring the fire safety measures and the possibilities for their implementation in accordance with the international best practices. Loopholes in the legal act with regard to the design of active and passive measures for the protection of construction works are addressed.
