8. Ministry of Agriculture Decree No 474/2000 laying down requirements for fertilisers,
as amended, pursuant to § 3(5) of the Fertilisers Act lays down risky elements,
risky substances and microbiological parameters, their limit values for each group of fertilisers, soil improvers, plant biostimulants and substrates, as well as tolerances. Pursuant to § 4(9) of the Fertilisers Act, it also lays down the types of fertilisers, soil improvers, plant biostimulants and substrates, mandatory procedures for the sampling of fertilisers, soil improvers, plant biostimulants and substrates, and for the performance of chemical analyses, biological examinations and tests. Pursuant to § 9(10)(e) of the Fertilisers Act, Decree No 474/2000 also sets cumulative limits for risky elements in all types of soil inputs.

9. The draft decree is a response to practical findings and feedback from fertiliser producers and suppliers. The draft decree also includes adjustments to align with similar provisions of Regulation (EU) 2019/1009. This is a national provision and does not transpose any European Union legislation. In the case of the modification of the derogation in the nitrogen content of nitrogen fertilisers, the proposal is inspired by an adjustment in Regulation (EU) 2019/1009 of the European Parliament and of the Council, however, this is not an adaptation, as the Decree does not cover products regulated by the Regulation. The Decree addresses national regulation. In the amendment to the Decree, the derogations and types of fertilisers have been revised, including the addition of new type products. Furthermore, the proportion of waste from wastewater treatment plants in the raw material composition of the final batch of fertiliser produced by composting or anaerobic digestion was added and the maximum number of germinating seeds or plant parts capable of vegetative reproduction was determined. At the same time, some formal inaccuracies in the text have been corrected. The draft decree complies with the Fertilisers Act and the authorisation to issue it is contained in § 3(5), § 4(9) and § 9(10)(e) of this Act.
