The provision requires fuel companies that make fuel products available for combustion in specifically designated sectors to surrender allowances equal to the amount of carbon dioxide released from the combustion of the fuel products. The operator, i.e. the operator running the fuel business, shall also monitor and report the emissions from the fuel products that the operator has made available for consumption in the designated sectors.

Fuel business operators are required to monitor and report carbon dioxide emissions from the fuel products that they have made available for consumption in the sectors listed in Annex 2 to the Ordinance on certain greenhouse gas emissions (Chapter 3a, Section 12). Operators are also required to surrender allowances equal to the carbon dioxide emissions released from the combustion of the fuel products that the operator has made available for consumption (Chapter 3a, Section 15).

9. The aim of the regulations is to introduce the new EU emissions trading system for fossil fuels, ETS 2, including the requirement to monitor and report emissions from fuel products made available in specifically designated sectors and the requirement to surrender allowances.

The regulations are part of Sweden’s transposition of Directive (EU) 2023/959 of the European Parliament and of the Council of 10 May 2023 amending Directive 2003/87/EC establishing a system for greenhouse gas emission allowance trading within the Union and Decision (EU) 2015/1814 concerning the establishment and operation of a market stability reserve for the Union greenhouse gas emission trading system (‘the amending Directive’). The amending Directive amends Directive 2003/87/EC of the European Parliament and of the Council of 13 October 2003 establishing a scheme for greenhouse gas emission allowance trading within the Community and amending Council Directive 96/61/EC (‘the ETS Directive’). Annex III to the ETS Directive lays down the sectors that are mandatory in ETS 2. However, Member States may choose to include more sectors in the emissions trading system in addition to the mandatory sectors (Article 30j). Sweden’s transposition of the amendments to the ETS Directive means that more sectors are included. This includes fuel products used as motor fuel in off-road motor vehicles and other work machines and recreational craft.
