Through this module, the Minister of Climate Policy and Green Growth may grant subsidies for the construction of production lines for batteries, electrolysers and solar panels.
The Regulation contains technical rules which define which production lines are eligible for subsidy on the basis of requirements for the products they produce. Those products must be of a particular type, or have certain characteristics:
- for batteries, only production lines for bulk batteries, lithium-ion batteries, sodium-ion batteries, redox flow batteries or solid-state batteries (Article 4.7.3(2)(a)(1));
- for solar panels, only production lines for:
a) BIPV solar panels or VIPV solar panels based on heterojunction solar cells or perovskite solar cells (Article 4.7.3(4)(a)); or
b) solar panels that are circular, lightweight or flexible, and PFAS-free (Article 4.7.3(4)(b)).
There is no provision on mutual recognition, as the technical rules apply equally to all production lines eligible for subsidy and do not differentiate between Member States.
9. The objective of this Regulation is to stimulate the deployment of production lines for batteries, electrolysers and solar panels, or for essential components for the transition to a climate-neutral economy that requires the production, storage and use of renewable energy sources.
The technical rules do not have any discriminatory impacts, since they apply equally to all production lines eligible for subsidy and do not differentiate between Member States.
The requirements are necessary to achieve the objective of the Regulation, since production lines must create products that contribute to the transition to a climate-neutral economy. Therefore, requirements have been laid down for the products that can be made by the production lines to be subsidised. For battery production lines, a subsidy is only possible for new, innovative battery production lines with alternative raw materials that offer greater benefits in terms of performance, storage duration, storage capacity and safety. The solar panels for which production lines are eligible contribute to the objective by being solar panels:
- made of solar cells with a higher efficiency than the current generation of solar panels on the market, or for which less material is needed for production, and which can be integrated into buildings or vehicles, thereby increasing their application possibilities;
- which are lighter in weight or flexible and therefore have more application possibilities, are circular and PFAS-free.
The transition to a climate-neutral economy is an overriding reason of public interest, namely environmental protection. The requirements are appropriate to protect this interest by ensuring that only production lines that create products that contribute to a climate-neutral economy and thus environmental protection are incentivised. The requirements do not go beyond what is necessary, since this delineation of products means that only production lines which contribute to a climate-neutral economy remain. The requirements are the least restrictive for achieving the objective and are proportionate, as they still allow producers to choose products of different types or characteristics.
