In application of the Law of 27 June 1937 revising the Law of 16 November 1919 regulating aviation, national aircraft may circulate freely across the territory of the Kingdom, unless otherwise provided by the Law/Royal Decree. The Royal Decree of 25 May 1999 was previously adopted to lay down the specific conditions imposed for the admission to air traffic of ultra-light motorised aircraft (hereinafter: ULM). This Royal Decree was amended by the Royal Decree of 21 October 2008. The purpose of this draft Royal Decree is to replace and supplement the Royal Decree of 25 May 1999. The latter will be withdrawn upon publication of this draft Royal Decree.

9. ULM are currently regulated by the Royal Decree of 25 May 1999 laying down special conditions for the admission of ultra-light motorised aircraft to air traffic, as amended by the Royal Decree of 21 October 2008.
In the 2000s, the world of ULM experienced a number of technological developments and a number of European instruments in this area were adopted.

For all these reasons, the industry expressed its wish to adopt a new Royal Decree replacing and supplementing the Royal Decree of 25 May 1999. The draft Royal Decree therefore constitutes a necessary revision of the current ULM legislation. The discussion was based on the following principles:
- Proportionate and updated regulation;
- Take account of technical and regulatory developments;
- Take into account (without copying) the rules in neighbouring countries.
- Give greater responsibility to instructors who work in the field on a daily basis and are able to ensure safety;
- Draw as much inspiration as possible from established European Union legislation;
- Facilitate transfers between licences;
- More solid theoretical training.
