8. A payment service provider shall only execute payment and/or distance payment transactions related to, or initiated by payment card for the benefit of, the entities on the List of entities authorised to carry out remote gambling activities in the Republic of Lithuania.
9. Illegal remote gambling has a negative impact on public finances. However, the social harm caused by illegal gambling is all the more important, since participation in such games does not provide a player with any safeguards. Illegal gambling is open to adolescents and young people, and to individuals on the list of persons who have voluntarily restricted their chances to gamble. Unrestricted gambling advertising activities make the gambling process even more attractive. The Lithuanian Gaming Control Authority issues binding orders to block both websites relating to illegal remote gambling and payments for the benefit of the illegal remote gambling operator. Since 2016, the Lithuanian Gaming Control Authority has blocked more than 1,600 illegal websites, accordingly issuing binding orders for payment service providers to block payments. However, practice shows that the use of blocking is not sufficiently effective due to the different payment methods used, and it is therefore proposed to introduce additional measures.
It should be noted that gambling activities are not harmonised at EU level and therefore, in accordance with the principle of subsidiarity, it is up to each Member State, in accordance with its own values, to decide and determine the conditions for gambling activities based on the grounds of general interest such as the protection of players, the prevention of money laundering, consumer fraud and incitement of citizens to excessive spending in connection with gambling. In the light of these considerations, an entity seeking to provide gambling services, including remote gambling services, in a given Member State must comply with the requirements of that Member State’s legislation governing the organisation of games, such as licences, authorisations, etc. An entity shall be regarded as an illegal gambling operator if it is not authorised, in accordance with the legislation of the Member State concerned, to provide gambling services in that Member State.
