5. Draft Order on nicotine content limits in tobacco substitutes.

6. The draft concerns tobacco substitutes. A tobacco substitute is a product containing nicotine that:
is not a tobacco product, an electronic cigarette or authorised medicinal product.

8. The Order sets nicotine content limits in tobacco substitutes. The amendment follows
notification 2024/326/DK, in which Denmark has notified a draft Act providing
authorisation to lay down the nicotine limits.

The Order calls for a a nicotine content limit in nicotine bags of 9.0 mg per bag. There is currently no nicotine content limit in other tobacco substitutes.

9. The Order implements the agreement of 14 November 2023 on a prevention plan targeting the use of
tobacco, nicotine and alcohol by children and young people concluded between the government
(Socialdemokratiet [Social Democrats], Venstre [Liberals] and Moderaterne [Moderates]), Socialistisk Folkeparti (Socialist People’s Party), Danmarksdemokraterne (Denmark Democrats), Det
Konservative Folkeparti (Conservative People's Party) og Alternativet (The Alternative).

The agreement contains 30 initiatives, and together they are intended to contribute to reducing the consumption of tobacco, nicotine and alcohol
by children and young people and to support more inclusive communities.

The Order implements the prevention agreement as regards the initiative to set a nicotine content limit in tobacco substitutes.

Point 15 Impact
The additions to the Order follow notification 2024/326/DK. The draft Act includes a review of the financial impact and implementation impact on the public sector, the financial and administrative impact on the business sector, etc., as well as the administrative impact on citizens.

The draft Order on nicotine content limits in tobacco substitutes is laid down
pursuant to Section 10a(2) of the Act on tobacco products, etc.

Basic text 2024/326/DK

Children and young people are particularly sensitive to nicotine and become addicted more quickly than adults. Nicotine negatively affects the brain and can have a serious impact on one's ability to learn, concentrate and pay attention. Nicotine can also have a detrimental effect on one's mental health and help provoke symptoms of anxiety and depression. The purpose of the Order is to reduce the risks associated with nicotine.
