5. Draft Order on the standardisation of tobacco packages, herbal products for smoking and technical equipment used with heated tobacco
6. This Order concerns tobacco products, herbal products for smoking and technical equipment used with heated tobacco.

8. The amendments to the Order lay down requirements for the standardisation of technical equipment used with heated tobacco. The amendment follows notification 2024/326/DK, in which Denmark has notified a draft Act providing authorisation to lay down the requirements.
The amendments to the Order concern:
- Colour requirements and packet elements on unit packets, outer packaging and wrapping material for technical equipment used with heated tobacco
- Surfaces etc. of unit packets and outer packaging of technical equipment used with heated tobacco
- Wrapping material on unit packets and outer packaging of technical equipment used with heated tobacco
- Labelling, etc. on unit packets and outer packaging of technical equipment used with heated tobacco
- Functionality, size, etc. of technical equipment used with heated tobacco
The additions in relation to the existing Order appear with amendment markings.

The amending Order is an implementation of the agreement of 14 November 2023 on a prevention plan targeting the use of tobacco, nicotine and alcohol by children and young people, concluded between the government (Socialdemokratiet [Social Democrats], Venstre [Liberals] and Moderaterne [Moderates]), Socialistisk Folkeparti (Socialist People’s Party), Danmarksdemokraterne (Denmark Democrats), Det Konservative Folkeparti (Conservative People's Party) og Alternativet (The Alternative).
The agreement contains 30 initiatives, and together they are intended to contribute to reducing the consumption of tobacco, nicotine and alcohol by children and young people and to support more inclusive communities.
The amendments to the Order implement the prevention agreement as regards the initiative on the standardisation of the packaging of technical equipment used with heated tobacco.
Children and young people are particularly sensitive to nicotine and become addicted more quickly than adults. Nicotine negatively affects the brain and can have a serious impact on one's ability to learn, concentrate and pay attention. Nicotine can also have a detrimental effect on one's mental health and help provoke symptoms of anxiety and depression. The added standardisation requirements should contribute to making products less attractive to children and young people. This should also be seen in the light of the fact that young people are particularly sensitive to branding and advertising.

This is an existing Order which is being revised in order to add requirements for the standardisation of technical equipment used with heated tobacco. The new requirements are shown with amendment markings.
No changes have been made to the requirements included in the existing Order, only new requirements have been added.

The draft Order on the standardisation of tobacco packages, herbal products for smoking and technical equipment used with heated tobacco is laid down pursuant to Sections 21a(3) and 30a(2) of the Act on tobacco products, etc.

The additions to the Order are in line with notification 2024/326/DK. The draft Act includes a review of the financial impact and implementation impact on the public sector, the financial and administrative impact on the business sector, etc., as well as the administrative impact on citizens.
