With the amendment of this Regulation, sellers of other pyrotechnic articles must verify at the time of sale whether the person purchasing P1 articles is a person with specialised knowledge.
This is because in Benelux, it has been found that a significant number of pyrotechnic articles of category P1 which in fact do not belong to this category but, for example, in categories F3 and F4 because of their appearance and production of loud bangs, are nevertheless improperly placed in this category by manufacturers or importers. As a result, these articles become available to persons without specialised knowledge and are used for entertainment. In order to prevent this, the Decision on combating the improper use of pyrotechnic articles intended for the general public was signed within the Benelux context.
The provisions are essentially based on the general interest of environmental protection and, in addition, public order, health and safety.
The requirement is appropriate, because with this provision these articles can no longer be legally provided for improper purposes. The provisions do not go beyond what is necessary because exceptions have been made for legitimate uses, such as emergency signalling devices used on water. Therefore, the requirements are also the least restrictive means of achieving this goal. Indeed, enforcement of already existing rules has not proven to be effective and does not work sufficiently.
8. The purpose of the Regulation is to implement the Decision of the Benelux Committee of Ministers on combating the improper use of pyrotechnic articles intended for the general public – M (2022) 7 (Benelux Official Journal 2022, No 2). To this end, the Regulation on other pyrotechnic articles is amended. A new Article 4a is added prohibiting the possession/use and sale of certain P1 articles to persons other than persons with specialised knowledge for P2 or persons holding a licence or equivalent document.
Given the nature of this Regulation – an amendment to the Regulation on other pyrotechnic articles by which the general public may no longer possess or use certain types of pyrotechnic articles of category P1 and these may not be sold to the general public – it is not possible to include a mutual recognition provision.
9. This Regulation implements a Benelux Decision. Persons from outside Benelux can purchase pyrotechnic articles in the same way as now.
