Law No 2024-449 of 21 May 2024 to secure and regulate the digital space (known as ‘SREN’) entrusted new powers to the Regulatory Authority for Electronic Communications, Postal Services and Press Distribution (ARCEP) regarding the regulation of cloud computing services. In particular, it requires providers of cloud computing services to ensure the compliance of their services with essential requirements regarding interoperability, portability, and openness of application programming interfaces.
Article 29 of this Law confers on ARCEP the task of specifying the rules and procedures for implementing these essential requirements. The draft Implementing Decree subject to the notification procedure thus specifies the conditions for the application of Article 29 and the time limit for specifying the rules and procedures for implementing the aforementioned requirements.

Due to the nature of the provisions concerned by this Decree, which affect cloud computing services, and in light of Directive (EU) 2015/1535, the French authorities are notifying the European Commission of this draft Decree implementing Law No 2024-449 of 21 May 2024 to secure and regulate the digital space (known as the ‘SREN’).

The French authorities point out that the notification of this Implementing Decree is in line with the notification of the draft SREN Law. In addition, this draft Decree is linked to the objectives of Regulation (EU) 2023/2854 of 13 December 2023 on harmonised rules on fair access to and use of data, which aim to remove technical barriers for switching providers and for the multi-cloud.
