8. The draft provides for the repeal of the applicable legislation currently in force, namely Presidential Decree No 120 of 13 June 2017, and introduces a simplified framework for:
a) the management of excavated soils and rocks classified as by-products,
b) the use at the production site of excavated soils and rocks excluded from the waste framework;
c) rules on the temporary storage of excavated soils and rocks classified as waste;
d) management of excavated soils and rocks at remediated sites;
e) simplification provisions for micro-sized construction sites, for which a production of soils and rocks not exceeding 1,000 cubic meters is expected;
f) transitional and final provisions.
The draft decree consists of 34 articles organised into six titles and 12 annexes.

The purpose of the regulatory intervention is to facilitate the implementation of measures involving the management of excavated soils and rocks in order to meet, first of all, the need to ensure compliance with the implementation deadlines of the National Recovery and Resilience Plan for the construction of the plants, works and infrastructure provided for therein, as well as for the construction of the plants necessary to ensure energy security. The intervention also aims to contribute to the promotion of the water infrastructure network adaptation to the new needs related to the drought phenomenon. The draft Regulation has also been prepared in accordance with the principles and provisions of Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008, ensuring adequate levels of environmental and health protection and ensuring effective controls.
