8. The proposal includes a prohibition on e-cigarettes and refill containers, with and without nicotine.

Norway has had a prohibition on e-cigarettes and refill containers with nicotine since 1989, as part of a general ban on novel tobacco and nicotine products. In 2021, the general ban was replaced by an authorisation scheme, and the ban on e-cigarettes and refill containers with nicotine was placed in a temprary provision awaiting the entry into force in Norway of the Tobacco Products Directive Article 20.

The Ministry now proposes a permanent provision for the prohibition on e-cigarettes and refill containers with nicotne, as well as an extension of the ban to also cover e-cigarettes and refill containers without nicotine.

9. The Norwegian Government has as a goal in the national tobacco control strategy, to acheive a tobacco and nicotine free generation for those born in 2010 and later. The use of e-cigarettes poses serious health risks, especially for children and young people. New knowledge about those health risks, in addition to a worrying increase in the use of e-cigarettes by children and young people, is the reasoning for the proposal to continue the current Norwegian ban on e-cigarettes and refill containers with nicotine, and to extend the ban to also include e-cigarettes and refill containers without nicotine.
