5. Draft Regulation amending Regulation No RD-02-20-1 of 2017 on the planning and design of buildings intended for the production, storage and trade of weapons, ammunition, explosives and pyrotechnic articles

6. The legal act updates the requirements for the planning and design of buildings intended for the production, storage and trade in weapons, ammunition, explosives and pyrotechnic articles (WAEPA)

8. In the draft, the following main proposals for changes are made:
- "the maximum design capacity of buildings accommodating AEPA” has been specified as a key feature of buildings accommodating ammunition, explosives and pyrotechnic articles (AEPA);
- for the purposes of synchronisation, the classification of explosives (in Article 4) has been replaced by the classification according to Regulation (EC) No 1272/2008 on classification, labelling and packaging of substances and mixtures and according to the European Agreement concerning the International Carriage of Dangerous Goods by Road (ADR);
- requirements have been added for the construction of AEPA-accommodating buildings designed in earthfill and for their adjoining protective structures;
— the requirements for risk assessment in the planning and design of WAEPA-accommodating buildings have been clarified;
- a new Annex 8a containing a table of the coefficients for the alignment of different types of explosives, pyrotechnic articles and gunpowder to TNT (trotyl) has been included, and the incomplete and imprecise current table in Annex 7 of the Regulation has been deleted;
- the fire safety requirements have been updated;
- new requirements for the technological platforms and the undercuts skirting buildings intended for the production of WAEPA, as well as requirements for firing ranges adjoining such buildings have been included;
- editorial changes or clarifications have been made to individual requirements and annexes of the Regulation in order to clarify or update terminology

It has been taken into account that the implementation of Regulation No RD-02-20-1 of 2017 has not been subject to a detailed expert study and analysis since its entry into force, and therefore a full review of the requirements of the Regulation and of changes in the conditions of its implementation since 2017 has been carried out, as well as an analysis of the need to update the requirements of Regulation No RD-02-20-1 of 2017 to achieve compliance with the applicable European and national legislation, European standards and good engineering practices.
