5. Executive Order on Medical prices and terms of delivery, etc. for cannabis intermediate products and cannabis finished products
6. The draft legislative proposal concerns the following products:
Cannabis for medicinal use, including cannabis herbal drug, cannabis bulk, cannabis intermediate product, cannabis primary product, cannabis finished product and cannabis produced as an API (Active Pharmaceutical Ingredient).

8. The legislative proposal contains the following main elements:
1) Formal resubmission following notification to the European Commission. The resubmission following notification concerns sections 5, 6, 7, 7a, 8, 9, 10, 11, 12, 13, 14, 15, 17, 18, 42, 43, 45, 48, 49, 55, 57, 58, 59, 60, 61 and 64a.
Following a review by the Ministry of the Interior and Health, it has been determined that the above provisions of the Act on a Medicinal Cannabis Pilot Programme are relevant in connection with formal resubmission following notification.
2) The Act on a Medicinal Cannabis Pilot Programme is made permanent
A key element of the legislative proposal is also that the medical cannabis pilot programme is made permanent (see the agreement on a permanent programme for medical cannabis, as referred to above).

The legislative proposal implements an agreement on a permanent programme for medical cannabis concluded on 19 November 2024 between the government (the Social Democrats, the Liberal Party of Denmark and the Moderates), the Socialist People's Party, the Liberal Alliance, the Red-Green Alliance, the Danish People's Party and the Alternative.
In addition to implementation of the political agreement above, another purpose of the legislative proposal is to rectify the lack of notification of the Act on a Medicinal Cannabis Pilot Programme, which was presented in 2017, and subsequent draft amending acts submitted in 2018 and 2021, respectively. In this context, the Ministry of the Interior and Health refers to a communication from the Commission in 2022 via the Danish Business Authority, in which the Commission made the Ministry of the Interior and Health aware that the Act on a Medicinal Cannabis Pilot Programme was not notified when it was presented in 2017, cf. the requirements of the Information Procedure Directive.
Reference is also made to the draft legislative proposal, which includes a description of the relationship to EU law.
