8. Article I may contain technical regulations. This concerns an amendment to the previously notified amendment to the Regulation on the designation of consumer fireworks (2025/0307/NL). As a result of this amendment, only fireworks for consumers are allowed to be stored and transported as 1.4G classified without additional measures (such as mesh packaging). For this amendment, bursting charges in batteries of single-shot tubes, batteries of mines or Roman candles, combinations of fountains, mines, Roman candles and single-shot tubes and mines are to be reduced to a maximum of five per cent of the total amount of pyrotechnic substance per fireworks unit. This measure is being taken following an alerting report by ILT and research by RIVM as to the necessary measures to prevent mass explosiveness. Annex I to the RAC lists the fireworks authorised for consumers. In this annex, the requirements for consumer fireworks are adapted to RIVM recommendations. A provision on mutual recognition is not necessary, given the nature of this regulation, which prohibits the possession, use and sale of specific types of fireworks in the Netherlands.
9. The measure is necessary because studies carried out by ILT and RIVM have shown that consumer fireworks can react in a mass-explosive manner. The measures are taken to ensure safety as an overriding reason in the public interest. The purpose of these measures is to eliminate the risk of mass explosiveness in order to ensure the safety of fireworks storage facilities and therefore the safety of local residents. The measure is therefore also appropriate, since the requirements for the composition of permitted consumer fireworks are adapted so as to minimise the risk of mass explosiveness. The measure does not go beyond what is necessary because scientific advice has been obtained from the RIVM on the measures to be taken. This advice is being followed and also does not go beyond the aforementioned scope. The measure is therefore also the least restrictive means of achieving the objective. In addition, there will remain a sufficient choice of firework articles available for use. The measure is non-discriminatory because it applies to anyone who buys or sells consumer fireworks in the Netherlands.

12. This decision rectifies an omission in the previously notified amendment to the Regulation on the designation of consumer fireworks (2025/0307/NL). It is important that this decision enter into force (well) before the turn of the year 2025/2026, so that fireworks with a bursting charge of more than 5% per pyrotechnic unit that are packaged in mesh packaging and that pose a risk of mass explosiveness are not sold to consumers for the upcoming New Year's Eve and may not be stored at consumer fireworks storage facilities, approximately half of which are located in residential areas. These fireworks, which cannot be classified in ADR hazard class 1.4 without the use of mesh packaging, appear to be capable of reacting explosively precisely because of the use of mesh packaging. The reason for the use of mesh packaging is that in the Netherlands, only consumer fireworks classified in ADR hazard class 1.4 may be stored in storages for consumer fireworks. This decision means that all fireworks that may be made available to persons other than those with specialist knowledge are classified in ADR hazard class 1.4, so that mesh packaging will no longer be used and there will be no risk of mass explosiveness. There are therefore urgent reasons due to a serious and unforeseen situation relating to the protection of human health and safety.
